Ohio. My son's father filed for shared parenting, which I agree to however he is getting married in Mexico and I don't agree for our son to go, how can his lawyer help him get this?? I thought he needed a notarized letter of permission for the passport. Do I need a lawyer for court?

There is a PRESUMPTION OF SHARED PARENTING/Joint custody in Ohio. Why do you disagree with your son going to Mexico?

His lawyer can petition for a court order forcing you to sign permission for the passport and granting permission to go.

Because Mexico is not a safe country. & He plans on sending my son back with his mom & people watching him during his wedding, not HIM.

For some reason, I have a feeling they will be at a resort, which IS safe.

Is there some reason you feel the child's grandmother is incapable of handling your son to travel home?

How much of this has to do with you having your nose out of joint because Dad is getting married and you just don't want y'all's son to be there?

Lol, Thanks for the laugh. His grandma has never flown & is a nervous wreck as is... & opposed to Ohio where he lives & his family is.

What is the big deal? People do resort weddings in Mexico, Jamaica, Dominican Republic and so on all the time. Dad can't have his child at his wedding because YOU won't be there with his child? Why would you think they won't come back?

I wouldn't say that you have no chance. It comes down to the particular judge and whether your reasons for opposing the trip are valid.

If, for example, there is risk of flight, Mexico is not a good place for a parent to take a child. Mexico does not cooperate very well with the Hague convention:

The U.S. Department of State has a travel advisory about travel to Mexico. It would depend on where they're going and how they're getting there.

If Dad wants to take the child, he's going to have to file for a court order to get permission and ask the court to order you to sign the appropriate documents. You will have the chance to present arguments as to why it shouldn't be ordered - hopefully including reasonable arguments like the above rather than simply throwing a tantrum. It will then be up to the judge to decide.


Is there anything in your existing custody order about travel out of state and/or out of the country?

Maybe but Mexico is on the Hague Convention warning list and also has a travel advisory from the U.S. Department of State. There are legitimate concerns about travel there.

Even resort areas in Mexico have been proven to be unsafe lately. I went to summer school in Mexico twice as a teen, and I adored the country. I also visited it many times as an adult, and adored it just as much.

Today? I honestly wouldn't go...and I cannot blame a parent who doesn't want their child to go there either. The government is not in control the way that the government should be.
