Why would he? Presumably since it was in your luggage you know what it is.

Otherwise it was your traveling companion's and he lied about it being yours. I certainly would not have just let him drive away without further investigation. It seems you don't know this mystery person very well. Why was he carrying your luggage - that makes NO sense.

I had no room in the cab of my truck to put it. I dont know what it is, I havent seen it. Ive known this person for about a month or so, and I am confident he wouldnt have lied.

If you admit to it being your suitcase, barring any proof the device was placed there by another, it is presumed to be yours.

I never admitted it was my suitcase to the officer. The topic of there even being a suitcase was never even brought up. At that time I didnt know they were searching the other vehicle. I didnt know I was being charged with having this device til I was at the jail. The officer never asked me if I had any property in the other vehicle.

Is it procedure for them to take the other drivers word for it that its my suitcase andlet him drive away? Since the suitcase was not under my control I can see there would be no way I could prove it was placed there by another. Heck I dont even know if it was found in my case, there were two other suitcases that were other peoples. Now what do I do?

Alrite easy, My "ISSUES" are that yes I was escorted, but not for my luggage but for my oversize load. I can only drive during certain times which causes me to have to park in areas that are nowhere near anything such as hotels,truckstops etc. In the case of going to a hotel, I park the truck and hop into the escort vehicle to the hotel. I do not have a sleeper so everything I have has to ride in the front seat ie, Mapbooks, lunch box, luggage, files for paperwork etc. Doesnt leave alot of room for stuff let alone drive. It helps somewhat to just leave my luggage in the escort vehicle as opposed to taking out, putting in my truck, taking out of my truck, putting back in escort vehicle.

I guess it may be naive to think I know this guy real well, but I would hop being with a guy day in and day out for a month I could figure out he is just a nice hard working young kid.

"Device" was the officers word for it. I dont know what qualifies as a device.
