The bad news:

Fraud is not an option here. You were married for over two years, and even though she started "stepping" out on the marriage shortly thereafter, so do many other unhappy people.

Her conditional gc is not based on lies from what you've said. Not provable, anyway. So again, forget that route. And it wasn't "her" marriage - it was "YOUR" marriage too and as such, those affidavits were obtained on your behalf too. You benefited from those.

Before I go further could you answer the other questions please?

As in, what exactly you filed? Did you attend the interview together?
how did i benifit?

You can get a divorce, like you were already told.

Or, I supposed, you could leave things as they are and stay married to her even though she is seeing other people, if she doesn't want to get divorced either.

so, i will need a lawyer then i suppose. and how much am i looking to incur?
will a divorce show up on background checks and reflect negatively?
what effect will a divorce have on her status?

Yes, you should get a lawyer.

No, it won't show up on a background check...the divorce itself is public info, so if anyone looked for it they could find it, but it's not the type of that employers will typically be looking for when they run a background check, they are looking for criminal history and sometimes credit history. Perhaps if you were looking for a job with the government or military, they might look for that kind of stuff, but JUST being divorced is not going to reflect negatively on you. Millions of people are divorced.

No effect on her status.

That's not how it works. You list your facts and evidence and from there it can be determined (by the courts) if fraud was involved. You don't get to tailor your facts to fit the conclusion you wish to reach.
