Nobody here can predict exactly what a Judge will decide. I would go ahead and sue. If you're lucky, once this "recruiter" sees you are serious and actually sued him, he will refund the money because he thinks he will lose in Court.

So, you're suggesting that the OP lie.
When it comes to your job, which is more important, standing on principal or standing in the unemployment line? Tell your spouse and kids what a moral person you are, while they repossess your car and foreclose on your house. Honesty and employment do not always mix.

The other fellow doesn't have to "refund" the money because the OP already got the money back. The OP would be on the receiving end of the lawsuit.

That's correct, I already received my money back. The recruiter feels I owe him for his services so that's why he is threatening me with a lawsuit and contacting my current employer. I have documentation of every coorespondance I had with him, I told him I was disputing the charges since he breached the agreement. If this would go legal does he need to prove that he did not breach the agreement or do I need to prove that he actually did?

In your situation it would come down to who the judge believes.
