If this does go legal won't he have to produce these Emails? I have copies of every Email I sent him and every Email he sent me.

The other fellow doesn't have to "refund" the money because the OP already got the money back. The OP would be on the receiving end of the lawsuit.
That's correct, I already received my money back. The recruiter feels I owe him for his services so that's why he is threatening me with a lawsuit and contacting my current employer. I have documentation of every coorespondance I had with him, I told him I was disputing the charges since he breached the agreement. If this would go legal does he need to prove that he did not breach the agreement or do I need to prove that he actually did?
In your situation it would come down to who the judge believes.
