Well as much as this thread is dragging on and on, I still have more to talk about. Now the stbxmil says she isn't leaving and has now invited the stbxfil and their german shepherd to stay over this weekend. I can't suck this up anymore than what I already have. Stbxmil is directly interfering with my quality time with my daughter. Given everything that has went on, do you guys feel that filing for an order of protection for the stbxmil to stay away from my home is justified? I do, but I am afraid of these can of worms that I may be opening up.
No, it is not justified. (Hasn't this already been covered? :confused:)

You know, you're going about this the wrong way. Why do you think they're doing this? Don't know? Well, I'll tell you... They want to bug you, annoy you, exacerbate you. They're doing this to get the reaction they're getting from you. And they won't stop until you're no longer showing your annoyance.

Easier said than done? Sure, but it will be good practice for court.

BTW, I wouldn't be at all surprised to find that your wife or in-laws are following your threads here.

Right now, you have the advantage of them looking bad in court. If you try to get an order of protection just because they annoy you, it will start looking like both sides are in a tit for tat spite battle. It is not worth it.

But remember, you're also not the "victim" here. Your poor daughter is. I can only imagine how awful this is for her.

My daughter is only 9 months old. It would be worse if she was older and was able to comprehend what was going on. They have gone beyond the point of annoying me. It's out right harassment and extortion. However, I am trying to tread carefully and do not want to provoke anything to cause damage to my custody case. This is why I am asking for your opinions.

I know I sound like a skipping record, I'm emotionally drained from all this. Freeadvice is my means to vent and to seek help aside from my attorney. I never asked to be in this position, but here I am. This is all new territory for me and I truly appreciate all the input everyone has given and continue to give. I am trying to stay as strong as I possibly can for my daughter

Well its 4/3 and the stbxmil,fil and dog are still in my home refusing to leave. Ive been staying away in hoping they will leave on their own. The stbxmil has been staying since 3/20. Are there any motions i can file to have them removed besides getting a tro?

Again, you are not going to get them removed until you receive exclusive use of the marital home...which cannot happen until you go to court.

I would have to say no to that. It appears the inlaws and mangy mutt intend to stay forever. Are they buying any food? Paying any utilities? Hell, even a judge would get sick of a bunch of free loaders in their house after a while.

Legally you are...either of you would have the legal right to do something like that because you are married and have equal legal rights to your child.

The problem with doing that, is that you would have to get past both your wife and your inlaws, which could result in violence in front of your child...and guess who would get blamed and maybe go to jail?

I really sympathize with your frustration, but you are focusing your energies wrongly. You need to focus your energies on getting a judge to make temporary orders giving you exclusive rights to the marital home, and a parenting schedule for both of you.

The parents of the child. Quite possibly the grandparents too. Which means the child would end up in the custody of the state. I'm sure this loving father doesn't want that to happen.

Stbx is only allowing me to bring my daughter out for the day. She refuses to allow her to stay overnights at my parents home. There is no court order stating I can not. If I do this and she shows up at my parents home can she be arrested for trespassing?
