What is the name of your state (only U.S. law)? CA
Hi,
I am a US citizen.
In 2001 I applied for a green card for my brother and his family (wife with 2 kids).
Our i130 and i797 were approved, which means that My brother from Taiwan can get green card- together with his family.

However, he is a well paid doctor working in Taiwan and he so he can't migrate to USA.
Is he allowed to bring his family to USA, get green cards for everyone, then return to Taiwan a week later so that he can renounce his green card (US residence)?
Thanks in advance

I don't understand why he would want to get a green card only to renounce it? Could you perhaps explain a little better?

Well, we heard that if my brother does not immigrate with his family, the rest of his family can't immigrate to USA. If that is not the case, then my brother would rather not immigrate. Only the rest of his family would. Does anyone know if my sister in law and my nephews can immigrate without my brother immigrating as well?
Thanks in advance.

(His wife and children would be here only through him - in other words, you can't sponsor non-relatives in that manner)

That's what we heard from other immigrants.

So back to our question:
Is he allowed to bring his family to USA, get green cards for everyone, then return to Taiwan a week later so that he can renounce his green card (US residence)?
My brother has no interest in immigrating but the rest of his family are.

I would think that, once his family get their green card, it does not matter if my brother dies or renounce his green card. They will be allowed to keep their green card.
Thanks.

I suggest you find an experienced immigration attorney.

You're talking about fraud. Their status is derived from his.

One of my immigration lawyer says he has rarely heard of people losing their green cards.
After my brother brings his family to USA, get green cards for everyone, then return to Taiwan, the rest of his family are on their own. Their green cards will not be invalidated or taken back from them, just because their dad abandons his green card/ permanent residence.

Thanks anyways for your help.

If you have a team of immigration attorneys, why bother with FA?

I suggest your magical immigration lawyer educates himself a little more, in particular learning about the word "fraud".

You're welcome.

Since he has no intention of living with his family in the US, one must wonder if there is a qualifying family relationship between him and the rest of the family in Taiwan.

"One must wonder" about a lot of things ihot posted. ;)

I think ihot will be best served by finding a "replacement" immigration attorney in his area, one who understands the law.

Or at least is willing to not taking oodles and oodles of dollars in the knowledge that s/he is fleecing someone ;)

Ok, there is no need to toss slurs here. There is no need to doubt that I have "magical immigration lawyer". My workplace offers free 1/2 hour consultation with them. I also have access to other immigration lawyers.

May I ask you if there is fraud when immigrants continue to hold on to dual citizenship after they naturalized as US citizens?
May I ask you if there's fraud when illegal immigrants are given free ride to a green card via various forms of politically-convenient- amnesties - even after they broke US immigration laws for over 10 years?
I see people getting away with immigration fraud all the time - don't you?

Thanks anyways.
