What is the name of your state (only U.S. law)? New York and California
My wife got an e-mail from her ex-husband stating for several reasons that if we step a foot on US soil, we will be arrested and held until court. We currently live in Germany and are planning to move back to the States to live for awhile.
He says we committed fraud on my son's birth certificate, which we technically did, I guess. They were in the process of a divorce, I put my name on the birth certificate because I'm the biological father. My wife lived in California with me and her ex-husband in New York. My wife technically lied and said she was single. She was advised to do this by nurses she talked to. They said it's not really an issue. I know taking legal advise from a nurse is not a good idea, but we figured they deal with this a lot and it would be okay. Either her husband or nobody should be listed on the birth certificate, apparently. He doesn't want to claim legal rights to our child, which I know he can if he wants, but he won't because he knows it's not his.
The rest of the things he claims are false. These are:
He says he "investigated" our case and said he spoke to someone in my family that told him they seen my wife abuse my child and that they think she shouldn't have custody. This is a fabricated lie! I don't even know why or how he thought this one up. He said he reported her to the CPS. Can I find out if he really did this?
He says my wife left the country to run away from credit card debt, to apply for a new visa to rid herself of the debt connected to her "old" Social Security Number. I'm assuming he's making this up because he's mad they're contacting him about her debt, which they shouldn't be doing because it's a private debt. Anyway, his claim is false because it's not logical. The only reason she had to file for a new immigrant visa is because we stayed outside the country for over a year, making her status void. And she will retain her Social Security Number and debt with her new status.
So he says he contacted Homeland Security and the National Guard about her crimes. Do you really think we will be arrested at all? This of course scares me because we will have our 2 year old son, and I don't want him taken away. Everything he's claiming is bull****. Should we worry? By the way, he is a police officer, but he's not a very smart one.
