"Transportation"? What about the wife's means of "transportation"??!!!!
"Location"? Are you arguing that the whereabouts of a given item of marital property is a factor in determining spousal possessory rights?
Do you find it insignificant that the OP makes no mention of the existence of a pendente lite TRO giving the husband exclusive use of the bloody truck?
1) I WAS AGREEING with you when I said "this" in my post.
2) I'm not ARGUING ANYTHING AT ALL. Certainly not that the location of the property has anything to do with possessory rights. But there's a HUGE difference between "if the truck is in your driveway, it's perfectly ok for you to drive it wherever you wish" and "If the truck is in a storage locker, you should go demand access and take it".
3) It is absurd for two (supposed) adults to play "who can steal the truck today?". If he doesn't have alternate transportation and she goes and takes the truck, he's going to report it stolen and she'll have THAT hassle to deal with, or he's just going to show up at her place of employment and take it back. Then she's going to show up wherever the truck is and take it. Ad nauseum. If he DOES have alternate transportation, perhaps something could be worked out for the duration of the divorce process.
