What is the name of your state (only U.S. law)? PA

I was the victim of an accident in may 2013. I was hit by the car behind me and then the car behind was hit by the car after him.
the driver in the 2nd car claimed to the police that he was hit first then pushed into me and the police recorded according to his statement although I said that's not right on the spot.

now the insurance company for 2nd and 3rd car each saying that the arbitration result are in their own favor and do not want to pay for my damage.
they also claim that they cannot give me the arbitration report.

I talked to my insurance company (ERIE) and they are also saying it's difficult to obtain a copy of that arbitration.

So where and how can I obtain this arbitration result. I'm both a victim and witness in the case.

thanks for any advice.

Your insurance company can do it, and they are working on it. You can of course file suit against both the drivers who hit you, if you and your insurance company were not a party to the arbitration. Do you have collision coverage and did you use it?

yes, i have collision, but the cost to repair my car is less than deductible.

1. I and my insurance co didn't attend the arbitration, can we still get a report of it?
2. by file suit against both drivers, do you mean my insurance co should do this or I myself need to hire an attorney to do this.

You shouldn't care less as to what resulted when Company #2 and Company #3's had their little powwow. They aren't your adversaries. Nor are you in privy with either company's contract with their respective insureds that would entitle you to access their reports, records, etc., . . . . including the results of the arbitration.

The people driving the cars that they insured are the bad guys. So if you are tired of getting jacked around (which is their specialty) and believe you are due to be compensated for whatever, then sue both drivers in the same lawsuit. And keep an eye on the statute of limitations.

thanks latigo. yes. small claim court is what I'm thinking.
can I sue 2 at one time or just sue the one (the 2nd car ) who hit me,

Sue them both, they are both at fault and you shouldn't care which one pays you as long as you get paid.

ecmst12.
if i sue the driver who hit me, will I have the risk that the lawyer of the driver will deny this by citing the arbitration between 2nd and 3rd driver . hence i lose in this and pay for his filing fee and lawyer fee.

so by sueing them together, at least one of them is responsible and to pay both of us filing fee and attorney charge.

Joint and several liability. They are both liable and that arbitration result won't even be admissible.

ecmst12,
if the defendent lawyer moved this case from small claim to general court, will that be a bad thing for me? and how shall I prevent that from happening.?

Sue them all. Let the judge figure it out.
Completely agree with OHRoadwarrior here. Why do you care, just let the judge figure it out. Talk to your attorney and sue them. You want to be compensated, you shouldn't care who pays it! All the best!
