in california how do i deed over 1% of my condo to my life partner?

What is the name of your state (only U.S. law)? california. i do not wish to run in hoa election; my life partner of 11 yrs. and i have learned that by deeding her 1% she is then an owner. (she DOES want to be on HOA board, must be owner first)

how do i do it? if cost is substantive, how much? (approx.)

See an attorney who will write up the deed. I suggest you carefully consider before doing so. Being intertwined in property without being intertwined legally (aka marriage/domestic partnership) can really be a mess if there ever needs to be an untying. I know you are forever. I know what you have can never end; but, sometimes it does. And, sometimes, due to medical bills or lawsuit, someone else can gain that interest. Perhaps you might want to put the property in a living trust that is worded in a way your partner would be considered an owner under HOA rules.

You do understand that doing this is at risk to you. You can't have a 1% fraction in a joint tenancy, so this would end up being tenancy in common. She doesn't ever have to give the property back and it can very much make it impossible for you to sell the property in the future. If she were to die, you may find her 1% transferred to someone hostile to you (parents ,children, etc...).

Life partner is a euphemism. You don't get the legal protections of marriage unless you get married.

The deed is simple, fill in the blanks, file it with the courthouse, but the actual implications are staggering.

You should also check carefully on both your HOA bylaws if such a trivial ownership right actually accomplishes what she wants (and if any other homeowner would be stupid enough to vote for a person who has onlya trivial property ownership interest). Further, you bank is perfectly justified in calling your loan for such a transfer. It could also open her up to unprotected liability exposure for being an owner unless you make very sure your property insurance is written to cover her.

i hope you don't hold it against me. actually, the life partner holds the deed. i have a credit score to match my shoe size/have never been solvent. she is too timid to be on the board. it's imperative one of us be; we've already a substantial constituency, looks like we're f.ed. period.

i'll grant you the knowledge this gal-5 time homeowner, knows her s.-was prepared to deed 100% to me, before the prop. mgmt. rep gave us 1% info. i am no con man. i was brought to tears. do i have the 'real deal'? gd right i do.

then if your credit score is so low, I would be concerned with possible creditor's chasing you and eventually taking action to foreclose in any judgment liens against you.

The fact your partner is willing to grant 100% to you, with you in such a poor shape, financially, is a scary thought. Sounds like she may not be as wise as you give her credit for as she would be jeopardizing her home because of your debts.

I never accused you of being a con man. Even if your motives are 100% altruistic, what happens if you die? What happens if you become incapacitated? That 1% can cause a lot of heartburn for your partner. I'm sure you have good intentions on the board, but again, why would someone who doesn't really own the property be someone I'd want to vote for?

Being an owner of the property isn't some sort of club membership that could be casually given, I'm just showing the pitfalls.

Now on the other hand, if you WERE married, you could have joint tenancy, and California being a community property state would extend all sorts of rights to the two of you. Further, there are federal protections that would guarantee the financing not be callable because adding spouses (or other relatives) is specifically exempted.

OP could simply let petite GF park in the designated space and OP can park wherever OP was concerned about petite GF parking where she may get raped in the walk back to the housing unit.


I know if I feared the possibility of my significant other getting raped that it was a large part of the consideration of my actions, I think I would be packing up and moving.
