What is the name of your state (only U.S. law)? California
My friend, who doesn't speak English that fluently, just recently got in an accident; he didn't know the procedures 100% since he never been in an accident before (he didn't even ask for the other party's information), and he's only contacted me when the **** hit the fan almost 2 weeks ago, even last night he texted me at almost 2 AM still begging me for help last night, but as a layperson, I'm out of ideas.
Anyway, my friend's car was hit by a large vehicle (don't remember if the adjuster said if it was a van or SUV) backing out of a parking space on January 27th (I know, it's been a while) at the Atlantic Times Square in Monterey Park, but the other party claimed that he was the one who hit their vehicle, and keeps threatening to file a lawsuit against my friend... There were witnesses, but they were not willing to leave information for a statement, and the police refused to even come down since it happened on private property. There were cameras, but the security insisted that he gets a court order.
With that, his insurance company has been uncooperative; both insurances rejected each other's claims as "he said she said", and due to that fact, his insurance is unwilling to do any further investigations, subpoena for the security footage, or even allow him to seek the counsel of their appointed attorney... Yet, the attorneys we've found on Yellow Pages and the one I personally know have rejected the case and referred him back to the insurance company, and one even called yesterday saying that it's too late to do anything, but he still wants to try to win this case.
Any takers, or someone that can at least be able to steer us in the right direction of turning the case in our favor? Thank you.
