Parking Lot Catch-22

What is the name of your state (only U.S. law)? California

My friend, who doesn't speak English that fluently, just recently got in an accident; he didn't know the procedures 100% since he never been in an accident before (he didn't even ask for the other party's information), and he's only contacted me when the **** hit the fan almost 2 weeks ago, even last night he texted me at almost 2 AM still begging me for help last night, but as a layperson, I'm out of ideas.

Anyway, my friend's car was hit by a large vehicle (don't remember if the adjuster said if it was a van or SUV) backing out of a parking space on January 27th (I know, it's been a while) at the Atlantic Times Square in Monterey Park, but the other party claimed that he was the one who hit their vehicle, and keeps threatening to file a lawsuit against my friend... There were witnesses, but they were not willing to leave information for a statement, and the police refused to even come down since it happened on private property. There were cameras, but the security insisted that he gets a court order.

With that, his insurance company has been uncooperative; both insurances rejected each other's claims as "he said she said", and due to that fact, his insurance is unwilling to do any further investigations, subpoena for the security footage, or even allow him to seek the counsel of their appointed attorney... Yet, the attorneys we've found on Yellow Pages and the one I personally know have rejected the case and referred him back to the insurance company, and one even called yesterday saying that it's too late to do anything, but he still wants to try to win this case.

Any takers, or someone that can at least be able to steer us in the right direction of turning the case in our favor? Thank you.

If friend wants to seek compensation from the other party he can file suit against the driver to attempt to do so. If he is concerned other party is going to sue, friends insurance will defend him of that happens.

He's trying to seek compensation from the other party, but like I said, the insurance is not willing to send their lawyers, and my connections + the attorneys we've found keep bouncing us back to the insurance.

How? Please enlighten me on how I'm "advertising" when I'm clearly asking for help, and if you read my plight, I don't see how I can offer anything. I mean, unless you need your computer fixed (I'm an IT Tech) or want my old Moto X I've put on eBay I can't think of anything I can offer that needs advertising LOL...

He chose to drive: all the excuses don't impress me or anyone else. There will never be 'any takers' here.

He can subpoena the security footage. What reason do the attorneys give for rejecting his case? He probably has no case, since no one is taking it. Or is it that he wants an attorney to work for free?

Apparently, your friend's insurance does not include collision. That would protect him from damage to his vehicle. The basic coverage only protects others from the damage your friend causes and their attorneys defend him in court. They do not provide attorneys to force the other side to pay for damages.

The specific reason is probably that it would not be profitable for them to take the case on contingency. How much would your friend be willing to pay up front to litigate the issue? How much are his damages?

If the damage is under $10,000, then your friend can sue the other driver in small claims court. No lawyers. Just keep in mind that, in court, it will STILL be a he-said/she-said.

Usually, in a parking lot accident, everyone's insurance ends up paying for their own car. If he does not carry that insurance, it is usually, absent witnesses, easier to pay and have your car fixed. If it is an old car, usually replacing the broken lights and bumper cover are under $500. Cheaper if you do not care about the color.
