No we don't go to court, I don't think we have a date yet, they bring me the papers and I answer to them so they send me a letter asking me to contact them to discuss the matter

OK. What were the "papers" you received?

Did you receive a court summons and complaint indicating you are being sued? Did you file with the court an answer to the complaint?

It appears the credit card company is looking to settle the matter with you to avoid taking you to court, perhaps by working out a payment plan.

If you know you owe the credit card company money and if you have no defense to the lawsuit (e.g., statute of limitations), settling with the company will help you avoid a judgment against you.

You would be smart to have the complaint and the attorney-letter personally reviewed by an attorney in your area prior to discussing the debt with the credit card company representative, this to best ensure your interests are protected.

Good luck.
