i wanted to know the exact marijuana laws i was breaking. i didn’t previously know about the new 200 grams law

Where do you live in Ohio?

Unless you are WAY off with your 3/4 ounce estimate, your possession of marijuana should be a minor misdemeanor which will not appear on your criminal record. It, like your stop sign offense, should result only in fines.

You can wait for the notice to arrive to see what it says - and then ask for advice and direction from an attorney in your area of Ohio.

Elisabeth, you said you had to go to court for the MJ, so you must have been cited for it. Does the citation/summons start the offense with... O.R.C.--, that means it was under state law. If not, it was a Municipal Ordinance, Township Resolution or a County Ordinance.

Possession of less than 200 grams is a minor misdemeanor in many areas now and is not a jailable offense. There can be a $150 fine. It is not an offense that shows up on a criminal record.

Not odd at all. Especially with the new laws.

Did you read all of the new city laws?

Elizabeth had in her possession less than 100 grams (according to her estimate).

I am not talking about the poster's less than 100 grams. If state law says between 100 and 200 grams is an M-4, localities can not make it a MM.

Don't have to read them, cities can impose greater penalties, but not lesser. I've studied Ohio's Home Rule provision under Article 18 sec. 3 many times and that includes Niles v. Howard: OSC

Study some more and read some more.

Please read Norwood, Ohio's Municipal Code on marijuana laws and penalties, 513.15, as amended to decriminalize possession of 200 grams or less. Read Dayton's new ordinance. Read the several other Ohio city ordinances that have decriminalized marijuana possession under 200 grams.
