Study some more and read some more.

Please read Norwood, Ohio's Municipal Code on marijuana laws and penalties, 513.15, as amended to decriminalize possession of 200 grams or less. Read Dayton's new ordinance. Read the several other Ohio city ordinances that have decriminalized marijuana possession under 200 grams.
Please link the ACTUAL Ordinance (s), not tidbits from articles. Also Norwood's online ordinance only went to 513.14, there was no 513.15.

Elizabeth, if you possessed under 100 grams, your offense is a minor misdemeanor REGARDLESS of where you live in Ohio and, therefore, it will not appear on your criminal record.

If you will note, the articles in question are less than two weeks old. Clearly the online ordinances have not been updated yet. However I will disagree with Quincy in one respect, according to a couple of articles I just read, the police in Norwood are uncertain whether they will be following the Norwood ordinance, or state law, which has stiffer penalties.

One of my posts was reported as well. Perhaps ADMIN thinks we should stick to Elizabeth's concerns since this is her thread.

Possession of 100 grams or less of marijuana is a minor misdemeanor in Ohio. There is no jail time. There is no criminal record. This is true REGARDLESS of where in Ohio Elizabeth lives.

Several cities in Ohio have decriminalized marijuana possession of 200 grams or less. How the police will handle marijuana possession of 100 to 200 grams in these cities is currently a question mark.

In Michigan (before the state legalized marijuana), many cities in Michigan had marijuana ordinances much like the ones Ohio cities have passed. Those who possessed marijuana were generally ticketed under the ordinance instead of under state law. I don't know how Ohio's police in Dayton or Norwood or Fremont or Oregon or other cities in Ohio will handle it.

Why are you done "arguing law?" Because you discovered your arguments go against the FACT that these ordinances that decriminalize marijuana possession under 200 grams were passed and exist in several cities? ;)

Here is the law for crying out loud:
2925.11
(3) If the drug involved in the violation is marihuana or a compound, mixture, preparation, or substance containing marihuana other than hashish, whoever violates division (A) of this section is guilty of possession of marihuana. The penalty for the offense shall be determined as follows:
(a) Except as otherwise provided in division (C)(3)(b), (c), (d), (e), (f), or (g) of this section, possession of marihuana is a minor misdemeanor.
(b) If the amount of the drug involved equals or exceeds one hundred grams but is less than two hundred grams, possession of marihuana is a misdemeanor of the fourth degree.
(c) If the amount of the drug involved equals or exceeds two hundred grams but is less than one thousand grams, possession of marihuana is a felony of the fifth degree, and division (B) of section 2929.13 of the Revised Code applies in determining whether to impose a prison term on the offender.
(d) If the amount of the drug involved equals or exceeds one thousand grams but is less than five thousand grams, possession of marihuana is a felony of the third degree, and division (C) of section 2929.13 of the Revised Code applies in determining whether to impose a prison term on the offender.
(e) If the amount of the drug involved equals or exceeds five thousand grams but is less than twenty thousand grams, possession of marihuana is a felony of the third degree, and there is a presumption that a prison term shall be imposed for the offense.
(f) If the amount of the drug involved equals or exceeds twenty thousand grams but is less than forty thousand grams, possession of marihuana is a felony of the second degree, and the court shall impose a mandatory prison term of five, six, seven, or eight years.
(g) If the amount of the drug involved equals or exceeds forty thousand grams, possession of marihuana is a felony of the second degree, and the court shall impose as a mandatory prison term the maximum prison term prescribed for a felony of the second degree.




It is a MINOR MISDEMEANOR. End of story. Punishable only by a fine.

Yes. Several posts in this thread were reported.

These posts were less about the laws that were passed recently in Ohio that decriminalize marijuana and more about how these ordinances couldn't have been passed because they don't conform with state law. My saying they did pass and they do exist apparently upset RJR.

But the quantity of drugs Elizabeth possessed are covered under both the state law's minor misdemeanor and under the new ordinances if she happens to live in one of the cities that decriminalized marijuana under 200 grams.

It is the "under 200 grams" of the new city ordinances that RJR has a problem with.
