Purchased my leased car...dealership just called and wants more money! please help!

Good morning,
And thank you for looking at this posting. I have been leasing an automobile from Acura. The lease is up on Feb 15 2019...I have two more payments to go. We went into the dealership to purchase the car on a new loan. We went through the entire 12 hours process over two days and walked out last night with our keys and a signed contract for the buyout of the car plus tax and the other nonsense they up sold me on. 12 hours later, I just received a call from one of the sales associates telling me that I have to come back to the dealership to redo my paperwork because they forget to add the last two lease payments into the buy out amount. I specifically asked that question and was told YES the two payments are in this amount...and signed my life away for another 72 months. Please someone let me know what my legal rights are in this situation since I have a signed contract for this car. Thank you so much in advance for any assistance on how I can handle this.

The last two payments are part of a separate agreement, the original lease. In that 12 hours you never actually read the document details?
 
I was paying off the original lease and moving forward. That was what we agreed upon. All they did was give me a number....the payoff is XXXXX dollars....sign here. Are you saying it should have been more complicated than that and that I have to drive back down there and give them what they want? What if i do not?

Your contract has a certain dollar figure that the dealership has agreed to pay to the leasing company on your behalf. If that amount is zero, then you will end up owing it directly to the leasing company.

I do not see any verbiage about that. It just looks like a normal contract to buy a used car.
In other words, your final two payments were not included. You're going to end up paying it either way. So go in and re-sign, or send the payments directly to the leasing company.

But the purchase of the car terminated the lease. How can he owe payments on a non-existent lease?

Any remaining debt from the lease would be merged the purchase of the car


And finally, he can’t lease the car and buy it at the same time

How did the purchase of the car terminate his contractual obligation to make a certain number of monthly payments at a certain dollar amount?

There is a number of an amount of "Other charges paid on my behalf" and its way more than my last two payments.
In THAT case, ask the dealership to explain what those charges are. If those are the charges to terminate the lease, then I agree that you shouldn't owe any more and the dealership should eat the difference.
 
These are great questions and exactly why I am here. I put faith into these idiots to close out the lease that I did with them three years ago. I was told this was happening. It is assumed I would not be leasing the car anymore.

My suggestion:

Tell them to forget about it. It was a misunderstanding and you will simply finish out the lease and purchase another car elsewhere.


The dealer is not who would ask for the lease money unless it was incorporated into the purchase agreement. The leasing company is who you would owe the money to if any was owed

Don't get me wrong - I understand where you're coming from. My point is that, if they didn't collect the money from you for the payments, then you are still obligated to make the payments. As I said, ask the dealership what that additional amount is for and you should have your answer.

Dealer acts as agent for the lessor so they have the authority to terminate the contract and by allowing a sale, have in fact terminated the lease.

Otherwise, op couldn’t have purchased the car since there is an active lease on the car
