My boyfriend and I had an altercation with another tenant and received a notice to vacate. Long story short, the other tenant was harassing and threatening us for days, saying that he “knew where we lived” and “wanted to get us evicted” and then my boyfriends $200 rain boots go missing from outside our front door 20 mins later. We have texts to our super asking for help and explaining that we were being threatened and stolen from, as well as calls to our landlord asking for help. The landlord dismissed it with an “I don’t have time for this.” The super actually gave us the name of the tenant. End of the story, we go down to ask him to leave us alone and ask for the shoes back, and he sucker punched my boyfriend. My boyfriend knows how to fight and the other guy didn’t, so he ended up with a bloody nose and my boyfriend had no marks. He called the police and we were arrested, but the police say the charges will be dropped. Can we fight this as we had asked for help multiple times prior to this altercation and we were ignored? We are fine with moving out now as we aren’t happy with this place, but want to negotiate not paying the rent until our lease ends in 3 months as outlined in our lease agreement. We would be willing to hire an attorney if that’s what it will take, but we didn’t start this situation, asked for help, and are now being blamed. We feel as though we were set up as we had anorher situation earlier in our lease that had been remedied however we feel as though since then, they have been looking for a reason to get rid of us.
