Can we fight/negotiate this “Notice to Vacate”?

My boyfriend and I had an altercation with another tenant and received a notice to vacate. Long story short, the other tenant was harassing and threatening us for days, saying that he “knew where we lived” and “wanted to get us evicted” and then my boyfriends $200 rain boots go missing from outside our front door 20 mins later. We have texts to our super asking for help and explaining that we were being threatened and stolen from, as well as calls to our landlord asking for help. The landlord dismissed it with an “I don’t have time for this.” The super actually gave us the name of the tenant. End of the story, we go down to ask him to leave us alone and ask for the shoes back, and he sucker punched my boyfriend. My boyfriend knows how to fight and the other guy didn’t, so he ended up with a bloody nose and my boyfriend had no marks. He called the police and we were arrested, but the police say the charges will be dropped. Can we fight this as we had asked for help multiple times prior to this altercation and we were ignored? We are fine with moving out now as we aren’t happy with this place, but want to negotiate not paying the rent until our lease ends in 3 months as outlined in our lease agreement. We would be willing to hire an attorney if that’s what it will take, but we didn’t start this situation, asked for help, and are now being blamed. We feel as though we were set up as we had anorher situation earlier in our lease that had been remedied however we feel as though since then, they have been looking for a reason to get rid of us.

Let's see if I got this straight. This guy told you he knew where you lived and wanted you evicted (no threat there) and you think he stole some boots and instead of contacting the police to report whatever threats he may have made and the theft of the boots your super boyfriend confronted him in his home and then when he defended himself your BF beat him up. The police arrested and charged both of you and then said the charges will be dropped (they likely don't have the power to do that BTW).

Does all that sound about right?

You want 3 months of free rent (and Brooklyn that could be like 7-8 grand) because you neighbor messed with your boots which you stupidly left out and the hall and then your MMA BF kicked the crap out of him?

Lady, you don't need a lawyer. You need a time machine and boot tray.

Do you honestly expect a judge to buy this nonsense?

Jesus you are all so wrong. We don’t want three months of free rent, we are willing to Vacate in the 10 days, we just don’t want to pay 3 months of rent when we will no longer be living here. After the boots were stolen my boyfriend saw him downstairs getting out of the elevator and asked for his boots back, and the guy looked at him and laughed while saying, “there are no cameras in the hallway, so good luck with that.” We didn’t think that calling the police would do anything as there are no cameras in the hallway so we had no proof. Everyone in the building has shoe racks outside their apartment doors, it’s a small building and our rain boots have been outside the apartment for 9 months. We told our super and our landlord about the threats and harassment and they basically told us to fuck off. We went to his apartment and spoke outside of his apartment in the hallway. When my boyfriend asked for his boots back the guy sucker punched him in the face, grabbed him by the jacket, pulled him inside and threw him to the ground.

If they have given you a notice to move out you can use that copy of the notice to show a court later on when you tell a court that you shouldn't have to pay any further rent on the apartment when they were the ones to tell you to leave the LL cannot fairly expect to collect rent from you when they are the ones who wanted you to leave , SO is the notice to vacate also clear as to who it came from? You can after you move begin to go by there in the evenings to look for signs of another tenant such as lights being on or Tv flicker as a way to try to see if the LL has installed a new tenant.
