Georgia. What kind of rights does the father have? The father of my son came and took him and refuses to give him back I've called the cops and I was told I have to take it up in a court.

Well, I would suggest you listen the police and go through the courts. This is a civil matter and the police only deal with criminal matters.

Why did you not take care of this detail? Filing to establish paternity and child support should have been one of the first things you as an unwed mother should have done. Your child deserves the support of both parents.

It does you no good to argue with the seniors here. Get yourself to an attorney and get started. You are just wasting time posting to the forum.

Is there a custody order? If not, the father has the same rights as you do.
Only a legal father has the same rights, in the absence of a custody order.

If paternity has not been established legally (parents weren't married, he signed no AOP, etc.) then the father does not have legal rights.

What Massie needs to do today is to start the ball rolling on:

* Establishing legal paternity of the child.
* Petitioning for custody.
* Petitioning for child support.

In Georgia, he could be on the birth certificate because he signed the AOP but he still has to legitimize the child.

If paternity has not been established then the OP can and should keep climbing up the chain of command at the police department until someone helps her.
