Georgia. What kind of rights does the father have? The father of my son came and took him and refuses to give him back I've called the cops and I was told I have to take it up in a court.

Why did you not take care of this detail? Filing to establish paternity and child support should have been one of the first things you as an unwed mother should have done. Your child deserves the support of both parents.

It does you no good to argue with the seniors here. Get yourself to an attorney and get started. You are just wasting time posting to the forum.

Only a legal father has the same rights, in the absence of a custody order.

If paternity has not been established legally (parents weren't married, he signed no AOP, etc.) then the father does not have legal rights.

In Georgia, he could be on the birth certificate because he signed the AOP but he still has to legitimize the child.
