My daughter was on an All-Star cheer team and left the team after 5 months. We signed a contract that included a code of conduct and, of course, a 'no refunds' clause. I paid for the 11-month program in full up front in a lump sum.
Over the course of the 5 months I also paid separately for a third of the competition fees, music, choreography, insurance, USAF registration, a personalized bin that is kept in the gym, a sponsorship T-shirt, a warm-up suit, a uniform, practice gear, sneakers, competition bow, and a bag. When my daughter left the team we had not yet received the warm-up suit, uniform, sponsorship t-shirt, competition bow, or bag, and the bin is still in the gym.
I asked the coach/gym owner if she would be interested in buying any of those things back from me (so she could have extra on-hand), and she informed me that I would not be receiving those items since my daughter left the team and I signed a contract that says 'no refunds'. I understand that I am not entitled to a refund for any of the money I spent, however I do not understand how I can purchase items (like the uniform and warm-up suit) and not receive them AND not receive back my money.
She has $600 worth of merchandise that she is refusing to give me.
What can I do?
