My ex has alot of criminal issues. He is an alcoholic , has had 3 owi offenses, 2 seperate charges of contributing to a minor, receiving of stolen property which is still on the back burner. All of this except 2 of the OWI's has occurred within the last 5 months. So far, they have just given him a slap on the wrist. I WAS SHOCKED!!!! He has given my son, who is nine, marajuana, and alcohol. We had him tested and reported it to cps, but the tests came out negative. With only small amounts, they said it may not show. Even did hair testing. Negative, said possibly done to early. He has came back with bruises. Reported and took pictures, however nothing was done. He has seen my ex in sexual situations as well as other people his father knows. There is documentation with cps for that. Right now we share joint custody.I thought in Indiana it was, three times you're out deal with alcohol related issues applied. Is there anything I can do to keep my son from going thru anymore? My son is depressed with anxiety and has been diagnosed with ADHD. Safety is a big concern.I want my ex to have supervised visits and I want to get full custody of my son. Do I have enough?

You would need to consult with an attorney and have them file for a modification of visitation more then likely.

How old is your son? Could he speak to the attorney to the fact his father has given him these things?

What county are you in?

Excuse Me!!!!! I hope you were'nt talking about me. My ex seems to be the trailer trash and I hope that's who you were talking about. It seems to me that you were not, however if you were talking about me, it seems you can recognize TT very easily.

To the person who cares- my son is 9 years old and yes, he is definitely able to tell. I live in Tippecanoe Co., however my ex and the divorce is in Benton Co.

I have seen a case here where a father was taking his son on drug runs and when he was obtaining the products to produce. When father was caught the son was 9 and was possibly going to be called as a witness. The judge suspended all visitation, mainly due to child being a witness. It is entirely possible that you could try to get supervised. The only thing I see possibly working against you is the drug tests by CPS.. but an attorney could advise you better on that. I would get a consult and see what they say before of course taking your child with you.

This attorney's office are pretty good and have decent prices as far as attorney's go. They also offer free consults and are located in Brookston so it's likely they do some things in Benton Co.

Obviously, Litigation, you have way to much time on your hands. We were'nt talking about your child. Sorry for the misunderstanding. Oh, someone like you probably could not reproduce. You have to be understanding and sympathetic for such a big responsibility.

It used to be, unless it has been changed that the third DWI in Indiana was felony. I never saw anyone get prison, but did know a man who got house arrest for it and this was in 1989!
