which again is still what the lawyer told him today.. so I tend to believe her over you thanks :) she said normal is 30 to 45 days.. and well seeing as we have longer than that.. but she did still say also that a Judge will expedite for a deploying soldier as well.. so lets see.. on that note, lawyer or you.. umm I will go with the lawyer thanks ;)
Right. The statute says that there's a 90 day waiting period (on top of all the other time delays involved) and your lawyer says that it's 'normally 30-45 days' (note that it's growing) and we're supposed to believe you over the published statute? :rolleyes::rolleyes:

if minor children are involved for custody.. custody does not have to be handled through here since custody has been handled through PA who has jurisdiction of custody.. there is a 90 day waiting period if minor children are involved because of custody and all of that.. but I will say this one more time, lawyer said custody will not be involved because PA has jurisdiction of custody and there is already a custody order in place

again I will believe the lawyer thanks ;)

Waiting Period Prior to Dissolution of Marriage in Oklahoma
In order to allow for the possibility of reconsideration and reconciliation, Oklahoma family law statutes require a ninety (90) day waiting period, after a Petition for Dissolution of Marriage has been filed, before a Oklahoma divorce can be entered by the court, if there are minor children of the marriage. This waiting period can be waived by the court for good cause, if the opposing party has no objection. Further, this waiting period is not applicable to some for cause divorces noted above.

So your position is that the NORMAL divorce in OK involves situations where the child custody has been determined elsewhere? And then the person files and gets in to see a judge within 30 days? And the judge agrees to sign the decree on the spot?

That's what you consider to be a normal decree in OK? You're even more delusional than I thought.

never did I say he signed it on the spot is normal.. that apparently is just for soldiers deploying.. it is to protect the soldiers from having to come back (when they cant just come back) if both parties are agreeing to the divorce.. Now the part will I admit that my words got mixed up is where I used the word normal.. From where I first looked before it did make it seem normal.. but as I have done more looking then usually it does take between 30 to 45 days.. in some cases it can be done 10 days after the petition has been filed and signed by both parties.. The part where it takes 90+ days is if minor children are involved and that is so custody and so forth can be dealt with as well.. which in this case, as I stated, the lawyer said that since custody is already dealt with in PA, that Oklahoma has no jurisdiction over that for his son... the lawyer is going to give the custody order to the Judge (I am not sure if that will be added in with the divorce papers or given out seperately) to show that custody is already in another jurisdiction and taken care of..

but most sites say that 30days (with no minor children) if it is uncontested is the "normal" from them... From what I am understanding from the lawyer is that his would fall in that category (even though he has a minor child with her) because their is already a custody order in place..
