it is apparant to me that your parents did not raise an idiot, because you have the ablity to ask question to find out a solution to a problem. you are seeking a solution because you are tire of running sweetie.

you are very smart and i have no double that you will do the right thing. the first thing you need to do is go to the nearest assembley of God church, repent of your sins, recieve God as your savior and claim the promises of your father: no weapon formed against me shall prosper. the second thing you are to do is tell the pastor of that church what is going on in your life. and go from there. if you need me send me a private messege and i will help you do the right thing. :D :D :D :D

you did commit a crime, you went AWOL, that is a crime, but i doubt that you will get a harsh punishment, considering that you were never assigned to a unit or anything, right now they may want you to finish out your enlistment, because of all the shortages, but most likely they will just discharge you
 
Plane ticket to Ft. Sill purchased. Flying out on the 26th. I am hoping so much that they just discharge me. I have spoken with GI Rights several times and from the information I am getting a discharge is probably what I'm going to receive. I have been gone from the Army for so long, would they seriously want to make me complete my enlistment even though I have been out of training for so long? I am no longer airborne qualified (have to make several jumps a year) and saddly have forgotten a LOT of regular military knowledge. When I turn myself in am I going to get any sort of say or be able to tell my story before they decide my fate? Thanks a lot for all the info and support. It is very much appreciated.

YOU are doing the right thing and that is the beginning!!
From what i understand this is the series of events
You will be taken back to your unit and they will decide if they are going to be responsible for you there or if they want you to be in someone else's care. This doesn't mean jail, though.
Second, you will be charged ...sounds like with an 85 or 86, which is AWOL or desertion.
Third, you will be given the name of your military counsel (your appointed JAG lawyer)
Fourth, you will be given the opportunity to bring in another atty, like if you have a friend, sibling etc who is an atty in the service OR you can bring in a civilian lawyer....very expensive although some firms do consultation work where they direct someone on site to do all the lawyerly stuff, but they are still calling the shots. Lots of internet sites to find someone knowledgeable.
Then you start the process of talking to your lawyer, which prob. won't be too long, as they prob. have bigger fish to fry. DO NOT BE TOO HASTY in whatever you decide as it will affect you for a long long time. The consensus on the websites is to stay away from a mental health designation....

Ask lots of questions. Remember that the three forums in which you may be heard indicate gravity of your situation. General courts martial is the most severe.
Please try and post and let me know what happens as hopefully our friend will turn himself in and be going through the same process.
 
Ok I was reading about your son or whoever it is your trying to get info for...Im not trying to make things seem worse or anything but his scenario is MUCH different than mine. Drug charges,several infractions on his military record, failing a piss test, etc. I was never assigned a unit so they have no place to send me or anyone to contact, and my military record is flawless. From the information Ive gathered, and just using common sence, I seriously doubt the United States government is going to want to have a federal case over me. Reguardless of what anyone says it operates just like a business and all that stuff cost money...Why charge me when they can just discharge me and be done with it? I dont know really, but I am seriously starting to think that I will be booted with an other than honorable discharge. I called the Army desertion point and gave them my info/ssn to check if anything has been filed against me like a warrant or something like that and they had nothing.The people at the GI Rights hotline have told me on several occasions that in most scenarios like mine the persons were kicked out with OTH discharges. Oh yeah and those few checks they deposited in my bank account have not been touched. So Im hoping the cards are going to be turned in my favor...only time will tell I suppose.
 
Ok I have been reading into the Ch.10 Discharge in Lieu of Trial by Court-Martial and I was wondering if there is a lawyer or someone very familiar with this doc who can explain a few parts to me. I understand the general idea of most of it but I just want to make 100% sure that I am capable of using this to its full extent. PM on this board, AOL: DataBitch1, or email [email protected]. I think you are right that the young man about whom I am doing the research might be in a whole different world of hurt. You were SMART to not spend the money. Friends i have in JAG said that AWOLs may be designated to go to a more severe type of courts martial and then when the two attys sit down , they agree to cut the paperwork by changing you to a less severe forum. so the forum question is not over until you walk into the room.
They also talked to me about waiving the courts martial in lieu of administrative punishment. I didn't take good notes on this info, but it sounds like what you are talking about: Ch. 10. From what i remember, ythe soldier says, i will accept whatever punishment you give me (which I think may be minimal confinement, like 30 days or less) and whatever type of discharge, just so we can cut to the chase and get this over with." AS I SAID my notes and recollection on this are sketchy so i hope some one more knowledgable writes to you.
Its incredible that the nat'l deserter hotline hadn't received your file. Thats a break for you.
In your eyes, I realize that it wasn't such a big deal for you to go AWOL--new soldier, not assigned to first unit, low ranking. But dont decieve yourself as to how the Army MAY look at it. To them , they spend alot of money on your basic training, airborne, etc and more than that, they are trying to run a less than chaotic organization, so they not only may feel that they have to make a point about AWOL but they also are maintaining standards.
Truely, I hope that things go well for you but please don't minimize that you broke a very serious promise to your country. Its ALL about integrity. Nuf said.
 
Yeah I understand that the Army has standards to follow and I am not trying to make myself feel better about the situation on what really going to take place. I am trying to make educatated guess' as to what the commanding officer in charge of this is going to do. Some of the things Im paying attention to are as follows:

10–4. Consideration of request
a. Commanders having discharge authority per paragraph 1–19 must be selective in approving requests for discharges in lieu of trial by court-martial. The discharge authority should not be used when the circumstances surrounding an offense warrant a punitive discharge and confinement. Nor should it be used when the facts do not establish a serious offense, even though the punishment, under the Uniform Code of Military Justice, may include a bad conduct or dishonorable discharge.
b. Consideration should be given to the soldier’s potential for rehabilitation, and his/her entire record should be reviewed before taking action per this chapter.
c. Use of this discharge authority is encouraged when the commander determines that the offense is sufficiently serious to warrant separation from the Service and that the soldier has no rehabilitation potential.

I have been in your shoes and I know exactly what you are going through!!

I turned my self in to the nearest military base which in my case was Ft. Irwin in Ca.

I was held there for two days then they shipped me out to Ft. Sill Ok

I myself was in the army at ft. riley & went AWOL & i was like that for 1 1/2 and got caught and the only thing i had was go about my regular duties while the paperwork went through for my discharge.If u decide to go back u may have to pull some extra duty & a article 15, i was told htey can even try to help u stay in but u will have to get psycological evaluation but from my own experience thats about it.To get my discharge it took about 4 months,hope this helps.

Need to find out about AWOL

I was AWOL at 1 time but went to straightened out & im discharged now & my question is i am wanting to become a pharmacy tech.Will this AWOL deal stand & if u cant answer this who can.

As a military member myself, I would agree...you should turn yourself in and they will probably just give you a DISHONARABLE DISCHARGE. This will tarnish you in the future (some). Talk to base legal when you turn yourself in and see if you can get a GENERAL DISCHARGE. I believe after 6 months it will become a Honarable. Also, cancel your ticket, save your money, turn yourself in at the nearest military instalation. They'll take care of it.

Do Not turn yourself into FORT SILL

I dont know where you are right now but I got into trouble while I was in the military for something far more serious than AWOL and have since done my time and now am back in the civilian world and can tell you that you do not want to go back to Fort Sill.

Turn yourself into a local military installation (reserve or active not national guard) They should have a Temporary Placement Unit. You will more than likely be administrativly discharged for the AWOL Probably Other than Honorable.

Do that and save yourself the trouble of going to the Brig if you get caught or more than likely that is what is going to happen if you go back to Fort Sill. If you go to a smaller Fort or Base that does not have a Brig than CID will probably not want to come and get you,

:eek: :eek: :rolleyes: :rolleyes: does n e 1 have any advice that they can give me about my fiance. he was arrested on the 17th october 2004 having been AWOL for 6 months. he got sent to colchester MCTC and had his sentence on the 18th on december 2004. he got sentenced to 6 months but only has to do three on good behaviour, so he is to be out on the 15th of march. they also sentenced him to soldier on, and to be sent to iraq on my birthday!!!!! i dont know if i can cope. we have been together for 2 years. we only get a 10 minute call a week, and as i live 190 miles away from the prison, it is difficult for me to see him regularly. twice he has attempted to commit suicide, due to the army not letting him out. he hasnt even signed a contract as he was awol on his 18th. is there anything that i can do to help myself and anthony? any opinions or similar experiences with good advice welcome.
