Can a college Charge for Room & Board if they do not even have a campus?

Ok it's Anthem College. My tuition, Books, and supplies are 10,918 for the 2010-2011 and Room and Board is 14,632. Which is why I'm questioning it. They tell us it's because the more they charge the more we get back in FA but when I went to Community college years ago I never had to take out a loan. and they had dorms on campus and a cafeteria. So I'm wondering why and how can this place charge me for something they don't offer... I actually got money back from my FA when I was at the other college.

So, they are charging you extra so that YOU can get more Federal Assistance back, for something you actually aren't receiving? That's fraud, and if the govt finds out this school is defrauding the govt - you can be sure the govt will come in and shut them down. And if you have any school loans, you will still owe for the cost - so if I were you, I would transfer out of there ASAP!

Seriously - fraud. And you may end up in trouble too if you keep going along with the fraud.
 
Since they have many campuses nationwide, you may have agreed to pay room and board in your contract.

I disagree with humusluver though that this is like his tech fee because in that instance students still have access to the technology/computer labs. OP does not have access to room and board, which brings us back to consideration. Without consideration a contract is unenforceable.

You should ask to have the charge removed although you should have questioned it when you first signed up, if you didn't.

However, even if the contract is unenforceable they may simply refuse to serve you, if you refuse to pay. They probably have many applicants who are willing to pay enormous fees without reading the contract. You might end up looking for a new school if you do.

In short, the contract doesn't sound legally enforceable. You could refuse to pay but you might not like the results. You could sue for the return of your fees but it would likely be costly. Next time you should read what you sign first and question BEFORE paying.

I agree with HL here. Although I'm not sure the government would go after the students caught up in this scam. They could technically but I don't believe OP or her co-students had any intention to defraud.

If the OP took out loans for the school, she will still be on the hook for the loans - and you can't default on student loans. Even if the school goes under - which is seems this school has a history of changing names when the going gets rough.

Certainly. I wasn't implying she wouldn't have to pay back the money :D Just that I wasn't sure the feds would be knocking down her door for fraud.

Thanks for the advice. A few other students are calling the depth of education to see what we can do. From what we found out so far none of our credits will transfer. So right there is a huge red flag. Many of us are going to be out of money and time wasted. :(
