Charged for online food order, never received. What do I do?

Recently about two weeks ago, I placed an online delivery order from Subway and little did I know it would be the most infuriating experience. I feel like i am in an episode of the Twilight Zone or Black Mirror. I need to know how to proceed. So about two weeks ago, I thought I would treat myself and some friends to a Subway order. I ordered two foot long subs and a wrap from Subway's website with the idea that if anything went wrong, it would be easily taken care of via them rather than the delivery service. Hah! I placed the order. I'm waiting and waiting. "Preparing". Finally about 90 minutes later, I get a text from Doordash and an e-mail that my order was cancelled. And it suggests I try again. Like a primo idiot, I did. I placed the order again via their website, same thing. "Preparing". Im waiting and waiting. Finally, I get a call from exasperated Doordash driver that she cannot locate the restaurant. I tried to help her but told her I was the customer, not the merchant. Finally she got the message and told me she was given my number as the merchant number and hung up. Two hours later, I got a text from Doordash that my order was cancelled and to contact the restaurant. So I called the restaurant from Doordash's official website and the phone number is DISCONNECTED. What restaurant operates with a disconnected number.

So I tried contacting Subway's corporate via their website. But could not submit the form because it claimed the restaurant ID was invalid. So after contacting Subway on Twitter, I finally received an e-mail contact. They wrote me and told me that the first order was autorefunded and sent me the receipt of that but that the second failed order was not and that they would tell the franchise to refund my money but that each franchise is independent. Well, the money was debited from my account, still no order and they have ghosted me. When I found a different number on my bank statement for Subway, it again told me, no more humans, go to the website. Ugh. So, I am at a complete loss as to what to do. A friend of mine, who is a Doordash driver suggested to me that I call Doordash and ask for a supervisor on the issue. The thing is I dont think there is much they do do for me as I ordered through Subway, not them. So, I have no way to contact the franchise as their number is disconnected. Subway corporate's e-mail is ignoring me now.

One of the big problems is the website says the 2nd failed order was "delivered". The only proof I have is the order tracker is stuck on received status and the text from Doordash informing me my order was cancelled.

And I am out nearly $50 for an order I did not receive for the food plus service fees and tip. What do I do? If I have the order reversed with the bank, I dont know which failed order to cancel as they both have the same ID number. I don't wanna get dinged because I have limited mobility and depend a lot on delivery. Do I file a police report? Is it legal for a business to take your money without providing service. Do I file small claims? And to whom? I dont know the franchise owner or have contact info? I am completely exasperated. And feel completely let down for trusting this process. I have never had an order go this horribly wrong before. I feel like small claims fees would be as much as the original order or more.

All I wanted was my blasted sub lol. I think I would have had more value for money if I had flushed it down the toilet. Thanks in advance for any advice.

Does the Subway you ordered from in fact exist?

How about just driving over to the store and talking to the manager. Bring screen shots of your order.

If that doesn't work, have your bank do a charge-back.
Lorenzo mentioned s/he has “limited mobility” and often depends on delivery. This limited mobility could preclude a trip to the restaurant.

Ahh - to address that. I have the same problem with a local restaurant. The number in the delivery vendor's system is wrong. The OP should look up the actual phone number using his/her favorite search engine.

I'm guessing that the problem in doing that is that the OP stated "because I have limited mobility and depend a lot on delivery..." That limited mobility may be a problem in getting to the Subway location.

...but not a phone call - or a letter.
The OP stated that the phone number given by Doordash for the store was disconnected. The OP may want to try to find a good number for the store with other searches since the Doordash web site number might not have been correct, but assuming it was then calling won't do any good. A letter is worth trying, if the OP can find an address to send it. If the Doordash driver couldn't find the place, then that too may be a dead end.

If that doesn't work, have your bank do a charge-back.
That's what I'd do, and do it promptly. Hopefully the purchase was by credit card rather than debit card, since credit cards offer more protection in this situation than debit cards do. Sorting it out with a debit card can be much more of a hassle and more time consuming. Federal law provides more protection for credit card disputes than for debit cards.

In at least most states, if you win your small claims case you get the filing fee and service of process fees added to your judgment. The problem though is that it is still up to you to collect that judgment from the franchisee, and that will be difficult if that location does not exist anymore. You might also be able to successfully sue Doctor's Associates, which is the actual name of the company that runs the Subway business because you placed the order through the Subway website. You'd want to read the terms and conditions of the Subway ordering web site to see if there are limits on your ability to do that.

I suggest you try going through your bank first. Explain the situation and the issue with the two orders. If you provide a clear explanation it should not matter which of the two orders actually went through. Then once you have a response from the bank you can decide what to do next.

There is a Subway not too far from us that closed down during the pandemic and never reopened. The website still exists. I wonder if something similar has happened here, especially seeing as how the Doordash driver couldn’t locate the local Subway.

Just to add a little more information about that Code section, it is very, very rarely prosecuted. In my quick research of the cases on that statute, I found exactly one appellate decision — from 1937. There are other federal statutes regarding defacing/altering currency, but they generally require an intent to defraud. Destroying your own dollar bills may be foolish, but that simple destruction of currency is not itself illegal.
