Concern about paperwork

When he lived in Alaska he had sent them to his drunken mother before he sent them to me. Once I had gotten them in my custody, I kept them with me. But I believed him when he told me that the paperwork was legal. My oldest son was with me until June 09 however he decided to stay with his father because I believe his father threatened him.

So you have committed adultery and quite frankly your husband has custody of the two children and left you with your lover.

Your beliefs matter not. PROVE that dad is abusive to the children. Oh yeah, you can't. Dad however can prove that you committed adultery and took a lover and quite frankly make a case that you chose new family OVER your children with him. Oh and custody will be decided in the state in which the children have resided for the last six months.

Do you mean other than the fact I have been in a stable home with a stable job for the past 3 yrs (not the same but better jobs each time) and the fact that he has not only moved out of state but also not kept a job and is NOW finally having to pay child support while I have worked with DCS on making my payments every month and ASKED them to take the money from my checks every 2 weeks so that they were paid. Would that assist me?

You don't have to be legally separated or divorced to have a child support order. You just have to be living apart. Its really not even very uncommon.

Because it costs money that right now I don't have. How DCS is involved is because he was on welfare when he was in Alaska and I was for about 2 months. But the minute I got a job I was off it. We were seperated when I got with my BF and he has been with 2 other women since. We don't know how DCS has been involved for so long. I know that I owe $50 that will be paid off tomorrow as soon as I get my check. But he still owes back over 9k from a VERY LONG story.

They have lived in Washington State for over a year. However they have been moved around from place to place because he cannot keep a job for long and cannot pay the bills.

No he is not. He is my BF and my ex ALREADY signed an affidavit that gives him NO RIGHTS to the child.

Back the hell off! WE USED protection that didn't work!!!!!!!!!!!!! And FYI I have now fixed THAT situation as well!!!!!!!!! I am working on the divorce. I was out of work for 2 months because of maternity leave. I tried to go back to work but the doctor would not release me and my boss would not let me unless I had the paper from the doc that said I could.
