Is the employee acting at the direction of the broker (i.e. the broker initiates the trade for the customer and the employee merely executes the broker's instructions) or is the employee taking the customer order and doing the trade himself/herself without direction from the broker? And in what state is the customer and brokerage house?
Yes, it is improper and if the brokerage knows it is happening and doesn't take steps to correct it, they can be in big trouble.
