Ok...stop and take a big deep breath.

How long have you and the children been in FL?

What do you mean by no "up to date" custody orders?

You need to find a way to get an attorney, you may have to borrow the money somewhere.

New York definitely can make rulings that FL would enforce, particularly if you don't or can't fight jurisdiction. You really NEED an attorney.
Can I have an attorney appear for me in NY> and I not show up? I have been avoiding process servers and sending mail return to sender for quite a while now and they have issued no warrants or anything

I am not really concerned with the warrant . The police department said it is not a major issue. My main concern is Does NY have jurisdiction over me now that I am living in florida?
I find it absolutley crazy that he can disrupt my life this bad from behind bars
Hon, I asked you questions and you didn't answer them. If you hit the quote button you will be able to see peoples questions so that you can remember to answer them all.

There could be more to it...or he could just be a jerk.
Of course there is more to this, but I can already tell from the responses that this probably was not this type of advice I was looking for I
and he is definately a Jerk, he has nothing better to do he is in JAIL

Ok...you have been in FL for two years. Get an attorney in NY and ask the attorney to challenge jurisdiction based on the fact that dad is incarcerated and you have lived in FL for two years. Get the attorney to challenge jurisdiction based on "inconvenient forum".

Has anything at all happened lately that dad could have evidence on to show you as unfit? Or that something dangerous has been going on in your life? The court cannot take custody away from a parent, and give it to a third party, without due process.

However, if you don't properly respond and challenge his case, he could win by default, no matter how wild and crazy his accusations might be.

Absolutely nothing has happened . He said through no fault of my own I have fits rage.
(I am the most passive person you will ever meet!)and get this : I brought the kids to hurricane alley" so they are in imminent danger as I am running from the law from my warrant and they should be given to his mother until my legal issues are resolved.

I moved to florida before this warrant was in place. I am a school teacher! I moved here for a job, I am not hiding from this warrant I only just found out about it when I received this letter.

WOW WOW WOW!

In your first post you stated that he wanted a warrant taken out on you, now you are claiming there is a warrant?

And you claim to be a school teacher?

You have said repeatedly that you have avoided being served. You just recently said that you received a letter. What letter?

You asked if criminals have rights in your title. Yes, they do.
