My partner (living in CA) completed a Devry related Medical Education Readiness Program (M.E.R.P), which stipulated a full refund of the 13k if a student does not pass the curriculum with greater than or equal to 70 percent. Passing the program would entail enrollment into Caribbean medical school (Ross or AUC) Toward the end of the program (before or around the final exam), they changed the criteria to 65 % overall with a 60% in each course. Based on previous accepted criteria documented in the curriculum my girlfriend 'failed'. However the institution said she passed and extended the enrollment to matriculate into AUC , which she did not want--partly due to the acceptance criteria randomly changing towards the tail end of the course and secondly because her final scores were still at 59.93% (meaning technically failed) for one of the courses. In emails and conversations with the program director, he insisted she "passed" and would not get her refund. She will not be continuing with the program and is trying to get her refund. Appreciate your guidance here.
