What is the name of your state? Maine

I was cited for indecent conduct this past weekend (consensual sex in public), which is a misdemeanor. My question is if my ex found out about this, could she use it against me to try and take away visitation of our son? It happened in a different town and Im sure she would only find out about it if she did some type of investigation on me. I know it was stupid of me but I wouldnt think it would have any bearing in a custody case?

Sorry, no pictures. Any chance since I have never had anything on my record of getting this dropped or plea bargain it down? Do I need a lawyer to do this or can I speak with the DA on my court date?

You should get an attorney. Did your "partner" get cited also?

Nope, just somebody I faintly knew from hanging out at this particular establishment. I know it was a complete immoral lack of judgement and I have contacted a lawyer for a consultation.

Goodness Maine must be a tough state! In Ohio they give you warnings for things like that! Not that I personally know that or anything.... :D

But seriously, consult with an attorney. This might not be as big of a deal as you think.

Yes, at first I thought he would just warn us but at least I didnt get arrested! I know its probably just going to be a fine since I have never had anything on my record. The only thing I was worried about is my ex finding out and then throwing a fit and trying to use it against me.

I can just give you my opinion but I would think she couldn't use something like this against you unless they labeled you a sex offender and made you register as one. And no, I don't think that will happen but, again, that's only an opinion.

Shamefully, I was in a back alley. It was a moment of weakness and in Maine, they dont make you register as any type of offender. I have done some research and people usually get a $500 fine with or w/o probabtion. Im assuming those who got probation didnt have a clean record. In any case, I am waiting to hear back from a local Lawyer. To be safe I probably should also contact my Lawyer from my custody case to get his opinion!

Who constituted the public? Were people actually watching or was there just the potential for people to see what you were doing?

Was the other person a customer, a waitress, a stripper? What kind of establishment was it? A restaurant, a bar, a gentlemen's club?

If the answer to these questions would identify you, don't answer. But, be sure to tell your lawyer so he/she doesn't hear any last-minute surprises in court.


I can't guarantee that what you did wouldn't have any influence on the judge's decision in a custody case, but what you do around your children is more important than what you do when your away from them.

It was with another customer in the club. We were not in direct view of the public but I think the cop saw us walk behind the club and followed to see what we were up to. Hopefully the DA will plea it down since I have no record! Im still waiting to hear back from the lawyer, if I dont get a call back today, I will try a different one.
