What is the name of your state?nj i am being sued by a ebay seller because he claims feedback I lef for him has hurt his business. Will I have to go to his state NY, for court. Or will he have to come to mine.. nj I really dont want to travel 7 hours for this BS..

artickitty ~ It was too answered. You keep saying that in each new thread you start. The problem is you do not like the answers you are getting. Have you been served yet? I said in my previous post that he is probably venting and it will blow over.
You do not have to create new threads. Just add a comment to the last thread and it will come up in all of the new posts.

It will probably be in YOUR state at your local small claims court (if NJ has those. . .it might be under a different name). Since you said he was the seller, usually the defendant and the buyer (both you) gets home field advantage.

If you could tell us what you wrote that would help as well. . .

She wrote in the feedback on ebay the competitors name and phone number to get even with this seller. It is all in her other posts, just look at them and decide for yourself what you think.
Again, I ask Artic if YOU HAVE BEEN SERVED? Do you not know how to answer that question?

The only way he can show your feedback hurt his business is to prove exactly how many true potential customers read that post and then decided to buy from the other seller. That's almost impossible. Ebay should have eliminated your feedback, but they didn't so he has more of a beef with them. You probably shouldn't have named the other seller, but your guy still has to prove actual damages. The forum, while it has rules and is governed by Ebay, is still a public forum open to almost any comment.

Wait until you see the paperwork. You can countersue for your costs based on that. It will be interesting to see how he calculates his lost toilet seat sales based on your feedback post. Since your post was your opinion about that transaction he isn't going to get far.

Dallas- I am impressed, you found my feedback, and thanks for your answer.. He claims eight people contacted him saying they didnt buy seat because of my feedback.--I doubt it. I also will be surprised if he would drive eight hours to NJ to go to court, but I guess you never know.

Holy hotseat! 8 people! That musta set him back about $1-200 (though maybe more at his prices). All he has to do is prove all this bs. Then, even IF he could prove your post cost him all 8 customers, he would have to prove you actually did anything WRONG. Duh!

The guy's on drugs....or, maybe not taking the ones he is supposed to.

If you actually get papers, play the game and countersue if it's not too much trouble. Just make sure you take a big "Bubba" along with you if this ever gets to a meeting in court. This is the stuff TV shows are made from. ;)

Oh, yeah....each of those 8 "lost" customers would have to either show up and testify or send notarized affidavits, which you have the opportunity to refute. So, he has "jack".
