You need to present the whole of the facts. You should have probated your parents estates instead of trying to steal from your incompetent brother. You will have all the time in the world when you are sitting in jail for a violation of CPC 368, if you are upset with your brother, then you'll love Bubba :eek: Please take the entire posting of this thread to a probate attorney. Have you called APS yet? Called PAI yet? Called NAMI yet?

You have a comprehension problem. Where in the world did you get the idea that I'm stealing from my brother? I want him to go to a coop or an assisted living place. That will cost money, which he will have. Because he's on SSI, they will be able to place him in a coop or some type of assisted living space. You have missed the point completely, you and others here, in your haste to condemn me. You're stumbling over yourselves trying to twist what I'm saying. Yes, I said he is overweight (you people changed it to "fat"), and yes I said he smelled. I was pointing out that he is sitting downstairs all day long, eating crap, no exercise AT ALL, and refusing to get a check up at the doctor. I have offered to make his appointment for him and take him to the doctor. No go, he won't do it. He has a vein problem in his leg which eventually will need surgery. He is supposed to see a specialist twice a year. When my mom died in 1999, he stopped going. He is a heart attack waiting to happen and there's nothing I can do about it. Perhaps the word "evict" set you people off. I should have just said "place" him somewhere, perhaps your blood pressures would have stayed down. You sit there at your computer, spout your uninformed rhetoric, and feel so good about yourselves. I have a real-life situation here. My brother wil be 62 in May, his health is declining and his sitting downstairs gaining weight is not what he needs as he's aging. If you have nothing to contribute but your moralistic crap, keep it to yourself, I don't want to hear it. You know not what you speak. Chill.

Why yes, "evict" has a much different connotation than "place". What your posts intimated was that you intended to essentially throw your brother out so he would have to find alternate housing. However, your lack of clarity is as much to blame as others' assumptions.

I would still suggest that you speak with an attorney.

Actually, my only previous comment was that I would count my blessings - and I would. Both that I am not in your situation nor in your brother's. I neither Cited legalEse, nor jump on you. So shove the attitude.

Both your social skills and comprhension leave much to be desired.

I happen to be a mental health professional in California so I know what I am talking about. This is a legal site and you came here for specific information. You don't like the advice, but I didn't write the laws. I am grateful that they exist to protect people like your brother who isn't doing anything to hurt or bother you besides not doing what you want and existing. He didn't ask to be born with a serious mental illness. You should not benefit by virtue of his disability.

I am comprehending very well what is going on, as can others who are familiar with such situations. Also since he is on SSI that still affects you and your house and that is why you need to consult a probate attorney. Is your brother on SSDI, has he ever worked?

It is illegal for you to abuse your brother whether or not you think it is or not and he still has rights. It's really too bad that your parents didn't arrange for him to have care by someone other than you after their death, but they didn't, they left that to you and you got the house so as to avoid paying the State of California their due, and you think that you deserve to get everything?

You need to have a realistic attitude and develop some compassion. If you don't, the state will.
