This is your first mention of any will, but that is only part of the story. As I said before, because your brother was on SSI the state can take their due. It WAS common place for people to disinheirit family members to protect the home for SSI and medi-cal repayment, there are other factors and laws. It is too complex to explain to you since you have a severe comprehension problem. Your brother is protected by law and will or no will you have a contract as his caregiver and unless you find an appropriate placement and allow him access to what would have been rightfully his, you can and will go to jail for abuse. The longer you put off making this right the worse you will fare when the law catches up to you.

Your brother has a mental condition. By takeing him away from everything he ever knew could do more harm then good.

What is the name of your state? California

I inherited the family home in 1999 when my mother died. My brother was living in the house and is still living in the house. He has a mental illness, but can shop for himself, etc. I would like to get him out of the house, it is clear to me that he should not be in an independent living situation and it's not working out with his living here. We have owned the house since 1955. What steps to I need to take to evict my brother?

I realize this is a few years later and you may not be returning to this web site. I'm hoping you somehow read this and respond back. I really need help and I feel for your situation as I know exactly what it is like
