You are correct...i allowed her there for ONE week as a tester....she came home.....i remembered what she had told me about her room. She had only said something about it one time. He never even told me himself. Im human. I forgot about it. Im have a buys life with my 1 yr old and my 6 year old that i have in several after school activities. And yes i feel bad for have forgetting that but it was only brought to my attention one time. After i did ask her and she said she was sleeping on the floor was when i told him she wasnt going to be coming back over for the week and he said it was taken care of.
The point being that it wasn't so drastic and terrible that it stuck in your head to stay on top of. So.... it wasn't that big a deal to you.

RIGHT NOW, if there's no court order, you can do whatever you like.

However, status quo tends to weigh heavily.
im sorry but i dont know what status quo means....and honestly he scares me and i want a judge to tell him he cant just take her when he pleases

It wasnt becase basement flooding is something that happens every day. Its how quickly the problem is taking care of is what matters. And when i asked her a month later if she was allowed back into her room since it flooded and she said no, then i became concerned because now its a mold issue.

Status quo means how things have been done up to now. So if kiddo's gone with him on a certain schedule for a period of time? It's likely to continue.

Which is why it would seem that it SHOULD be a bigger deal than it was to you. Seriously - this situation is likely a nonstarter. Especially if you don't have an attorney.

But the schedule we have for the school year is he gets her every other weekend. That is what hes trying to change. He gets her every other week in the summer.

Will the mold not be an issue in the summer?
honestly what i wanted out of the emergency hearing was for a liscenced mold specialist be sent to his house and examine the basement for mold. If mold was found then i would not want her to return until it was found to be gone.

And certainly not after ONE nose bleed.

Which is why MOST adults/parents would have kept on top of the situation. That you didn't shows you didn't think it was a problem.

Ok then so im better off just filing for custody and having our schedule written in ink there.....mean while, waiting....i have to worry about his threats and picking her up from school and not bringing her home.
