I believe the OP said dad has already gotten ahold of this information by presenting an alleged court order to the insurance company demanding the information.

I don't think they actually gave him any information, but it doesn't matter. There are no circumstances where it would be possible for dad to violate HIPAA here. HIPAA binds health care providers, insurance companies, and other people who have access to health information as part of their business. It does NOT bind patients or anyone else with access to health information. For example, if you tell someone about your mom's surgery, then you have NOT violated HIPAA, no matter how much she might not have wanted the person you told to know anything. And it is NEVER a violation for someone to ASK for information. If there's a violation, it's in the releasing, not the requesting.

I hate playing the what if game..but...

If he was able to obtain some sort of information regarding me, my husband or infant, and attempts to use it in court, what are my options?

The reason I ask is I was recently treated for cervical cancer and I do not want dad assuming anything based on what he might have found out from my insurance company. In the same month I recieved treatment for cervical cancer, our daughter had a dentist appointment. Therefore, our information would be on the same statement. Also in this same month, my infant was referred to a specialty clinic for further testing on an unusual birthmark on her head.

Dad has a history of digging up the most personal information about people and using it against me, including other people health conditions This is why I'm scared of him getting my information.

Also, he has a very abnormal view on birthmarks.....

I would suggest your husband get his human resources department and union rep involved. They just may be able to get the information more quickly thana subpoena. If your ex is trying to get himself added to the company policy, they are going to want to get their legal department to look at those documents.

I suggested that to my husband myself. He's going to contact his rep tonight.

In regards to the health insurance information: I hope everyone can understand that I am only trying to protect myself, and my loved ones who are not legally tied to my ex. I recognize that he is our daughter's only father, and have honored that every bit. I have never tried to prevent him from having access to her, or anything about her. But, I have seen him distroy my family members in the saddest of ways. Over the years I've become extremely protective of my personal life, and the lives of my family.

I think that's fairly clear in your posts. You haven't done anything to make anyone believe you are doing anything wrong. The issues with your ex are alarming on so many levels. I feel for you and it is very concerning to me that he has had these issues with weapons. I don't know what to tell you to do about that except to echo LdiJ and just tell you to be very careful and observant of your surroundings at all times. And hope that things change for you very soon.

No explanation is necessary. There is no reason for your ex to have access to your health insurance information except as it directly affects his daughter, and it appears that he already has that. The attempts to get himself added to the policy or to get information from/about the policy as it affects you and your husband are completely out of line. I don't think there's anyone here that doesn't understand that.
