And even if they don't have it covered in their TOS they are selling advertising. It would be like suing AT&T because they sold a big ad to a crappy lawyer.

NOTE: The above is assuming AT&T still even produces phone books.

The only problem with the analogy is if they don't make it apparent that it is an advertisement.
