85 days and UPDATE!!!

It has been 85 days since my fire, recap is that the Insurance company wanted to repair and not replace the building and sent a check ( which we did not cash). We argued the point and Pointed out the NH RSA 407:11 they provided.

Recieved a phone call today from Our PA, they are paying the full claim. Im gun shy, but feel like celebrating !!

Im ready to bang my head against a WALL

So we went ahead and Demo'd the site , everything is gone. Yesterday we recieved word the Insurance Company Changed their mind, they never said they were replacing, dont consider it a total loss and are going to Repair it.


Now there is literally nothing to repair, Its Gone.




Im ready to throw myself off a bridge.

You demo'd without a written settlement? I understand the enthusiasm, but, that does not seem reasonable. You may win in the end, but you also may have put yourself in a worse situation. Slow down and think from now on. I know you don't have a home and money is flowing like water, but, you can't really rely on the verbal instructions at this point. Everything needs to be in writing.

I know, I should of knew better, I relied on the information provided to me from the PA. And in my enthusiasm, went with it.

He said we had the green light, and we took it.

Update Once Again

So this has been long emotionally taxing time. Since my last posting ,we continued to go back and forth with the Insurance Co. We would submit paperwork , they would counteract with every excuse as to why they shouldnt pay.

We ended up taking out a loan to replace our home , since we needed a place to live. While still fighting the insurance Co,
About 3 weeks ago, we filed a complaint with the State upon the advise of our PA, they confirmed reciept of the complaint, and told us the Insurance Co had ten days to respond per law, we hadnt heard anything, and Ironically enough over the weekend I thought , I have to look at the date of that letter, there should be some update soon.

On Monday of this week , Our PA called and asked if we recieved anything from the State, we stated no as we had not, He stated he had recieved a message left on his voice mail from the weekend, from the Insurance Company that they were paying the claim in full.
Having heard that at least 4 times already , I was monotone , LOL.

Yesterday in the mail I recieved a letter from the State saying that they were pleased with the results, and attached letters they recieved ,( in in turn the Insurance CO said they sent us as well, still nothing) It states they are paying the claim in full , and consider it a total loss.

I am a little more optomistic, although My family has gone thru phsychological hell for 8 months, Id like to hire a lawyer for the pain and suffering they have put my family thru.

I still have to settle the ALE , but maybe now that they realize big brother stepped in , it will go smoother?

You do NOT have a pain and suffering claim for this. Don't waste your time. You contributed to putting yourself through this "hell".

You do NOT have a pain and suffering claim for this. Don't waste your time. You contributed to putting yourself through this "hell".
How do you figure that?

You contributed by jumping the gun on demoing without the settlement.

Pain and suffering over your own destruction of property? What physical pain and suffering did you encounter? What personal injury was involved that was exascerbated by this? Oh yeah. NONE. This was a PROPERTY issue and not personal injury issue. Hence, NO PAIN AND SUFFERING. In addition, YOU caused your own issue.

pain and suffering are types of damages applied to when a person is physically injured. You are speaking of what is called; emotional distress.

Even that is not a valid claim given your situation. It is just not something the laws were designed to address in this sort of situation.



The only "extra" claim that may be possible would be for expenses caused by their actual and improper delays. If they caused you to expend money that you should not have (and I caution you, not just something you feel you should not have had to pay but something you did have to pay due to their actions that either were intentional, negligent, or beyond the accepted practices for an insurance company as, defined by law) you might have a claim for those expenses. Personally, I would stick with getting this settled and move on.
