The stepparents have NO legal rights to a child. That includes spanking the child -- for whatever reason. That is no different than if I -- or any of you -- were to wail off and punch someone. It's assault. Simple assault. Civil assault. And if an object is being used...hmm...sounds like aggravated assault to me.

You are missing the part about in loco parentis. In this case the father is giving the stepparent this right by not objecting and leaving the child in the care of the stepparent when he cannot be therefore. Children -- and this is really conflicting to how adults are treated -- are allowed to be punished according to law by using corporal punishment or spanking or hitting as long as it does not leave bruises. It is not right and it is not fair and if you hauled off and his another adult in the way you hit a child, it would be battery (assault is verbal). battery is the unlawful touching of another individual in such a way as to cause fear and apprehension. however spanking a child is NOT unlawful because discipline is allowed under the law. See the problem? The world is messed up. The forum is actually quoting the messed up world's laws.

I should have added in many states, including Ohio. There are of course requirements that the parents permit it and what not but it is allowed.
