here are the allegations and the findings from the preliminary report
first the investigations findings:
here is the reason why they are starting this proceedure
you did at or the near the state university interstate commerce, including through the use of the ako on various and divers occassions from between and the dates are given knowingly posses images of child pronography to wit:
visual depicitions of minors engaging in sexually explicit conduct

the information in this report is based upon an allegation or preliminary investigation and may be changed prior to the completion of the investigation
Exchange and distribution of child pornograhic images and movies exhibiting bestiality (sexual relations between humans and animals)

disclosed child porno images was identified on the computer harddrive. as the examination was not complete the extent of the images was unknown

and finally the university is stating that i used my husband ako account to view porn images,,, (first off i dont know my husband military username and or password,, )

this investigation is still pending completion of the forensic examination and the examination of husband ako account history..

the date of this investigation was done on march 15, 2005 and now its june 9,05,,,

now here are the charges
computer fraud, pornography, bestiality

this is the reasons why they are starting separation proceeding against my husband


ok,,first and foremost if the army looked into husband ako account they would have seen that no child or adult porno was transmitted after his return to the states which was on or about 2/04. they are stating that upon his return to the states he transmitted child and adult porn,

we also feel that our phone is being tapped and also bank and credit card statements looked at

i have stated that we have the images..

we have discussed this situation and i know for a fact that there are no animals pics and or child porn,, i have the pics that they claim they cant view and its not child or animal sex,,,
and if i could i would invite you all to see and judge for yourselves what the images are,,

OK, a few things don't make sense here. First, when the Army charges someone with bestiality, it's because they believe the SERVICEMEMBER was the one having sex with the animal. Possession of these types of images, in and of itself, is not a crime. Your husband's Army KnOwledge account (AKO) is a government account, not private. Prior to his signing up, which is now mandatory for all active duty and reserve component soldiers, he was given a use and understanding statement to read and sign. Additionally, everytime a servicemember signs on to the AKO website, a large, blue disclaimer page pops up, telling him about AKO being a government website, and any unauthorized usage could result in prison, fines, discharge, etc.
Second, you repeatedly state you still possess the images that you transmitted to your husbands' AKO account. If it's not child porn, and you're certain of that, then provide those images to CID. Prove your innocence. I know that's not fair, "Innocent until proven guilty" and all that, but realistically, if the investigators don't find proof of innocence, then the evidence they have will prove your husband's guilt. Your husband's done in the military, it's just a matter of how hard he's going to be hit with the book. When he transmitted the porn images from his AKO account to his private account, using his government account, he violated military and federal law.

i apprieciate your responds, and will wait to meet with jag and show them the pics
soo the charges of sex with animals is a farce, then why bring this up as well

the statements make no sense,, and to say the investigation is continuing makes no show at all to me,,

also what about the others who sent husband nakie pics on his ako why arent they being accused of this matter,,

they are worse crimes than this
now in your opinion does this warrent being kicked out of the military and why?

a little more information regarding this mess
the allegation that was made by my husband fellow employee was made on november 19, 2005 up until feb 13 or so
not once during this time frame did my husband use his ako email to send porn,however he did recieve porn from other members of the military, why arent they being looked into?

i have stated this arguement before the sending of these emails took place in the fall of 2003, why didnt the people watching catch this and give husband a warning of transmitting and or receiving
and also husband has been in the military for a long time with a clean record

You don't know the full extent of what was or was not sent. At first you said this involved only pictures you sent. Now you say that he received pictures from other servicemembers. You probably don't have any way to confirm or deny what has been done. When the government completes its forensics it will know whether or not it has a case. Just don't be too shocked at what they might find.

Secondly, for the last time I'll say it: get a lawyer! And to be honest you might want to consider getting your *own* lawyer, i.e. one who will represent you and not just your husband. If you had joint use of computers involved, etc. then you may be charged right along with your husband (in the worst case scenario he turns against you). Child porn is a serious felony and a hot button prosecution. You will probably get about zero slack from the government.

You say the government has not recovered any viewable images. But you don't *know* that. Remember, the government can and does lie during investigations about what it does and doesn't know. They may have a case already and be stringing it out.

On a final note, I think something posted earlier may not be entirely correct. Photos of bestiality are probably are illegal, just as photos of child porn are. If the recorded act is illegal then likely any 'prurient' images of same are. I don't have any precedents to cite, but someone else may. (this raises questions about the legality of homosexual porn in places with laws against sodomy, etc. It is a controversial issue, but the last thing you probably want is to be the subject of a law review article...)

Especially if you have kids yourself.

just a little update: Hubby spoke with the major from jag, and like so many she was a little perplexed about cid not taking our lap tops and other computer. and she was shocked to learn that the fbi and state police has not come to the house to due a search. she also asked hubby how many images are they the cid claiming to have "noticed" and he told the major that to this date no one has told him and he used the words that are written in the paperwork that was given to him by the unit "images are unknown. Back in june was this paperwork was given hubby's unit personnel told him that he would be unable to drill with his unit, according to jag this information is incorrect.. so i have a question, he is entitled to that weekend pay.. and now who notifys his unit that he is allowed to drill.

i read a previous post about a solider in iraq who is having his laptop searched for what ever reasons.. why is porn soo outlawed,, and from my understanding so is sodemy,,
from my understanding of history our forefathers wrote the constitution to protect us from government freedom to read and write, freedom to view, if porno is soo against society why is it allowed to be printed.

I am guessing they will not give him his pay since he didn't attend even though he was told not to.

The goverment constitution does not always aplly to UCMJ.

my husband has recieved information from his command unit that his is busted from the rank of sfc to pvi and discharge with less than honorable

no where on the distribution list does it list that information was sent to the jag officer in charge of his case...

is this a done deal, and why hasnt his jag officer notify of this discharge.

also and now that the military has kicked him to the curb does the state come after him?

I don't think they can bust him down like that unless they court-martial him. Did they court-martial him?

they did not have a court martial,

the jag officier is requesting that husband get a list of character witnesses together with email and phone numbers

please help to understand the military do the hang you first and ask questions later?
