Would like to know where and when I made the violation. I traveled from Queens to Brooklyn on Subway and then asked the driver on the Selective Bus Service where to sweep my card, he told me to move back and I moved back. After two stops a Inspector comes and asks me where is my receipt. I said I have metro card, I asked the driver where to sweep my card, but rather answering my question he told me to move back. He pulled me out of the bus and gave me a ticket of $100 for violation of Rule 1050.4(a). It was the job of the driver to tell me that go out and get a receipt to travel in this bus. I had a valid transfer from bus to subway. Then I explained the whole situation by mail to adjudicating officer, he writes me that NOV is valid, relying on Bus Driver statement is no defense. Let me make it clear that this was the first time I was using Select Bus Service, there were no sign inside the bus or outside the bus, yes there were few boxes about 50' away from where I boarded the bus. I am entering your property asking where to render my metro card, you gave me permission to remain on the bus, which is against the law and made me more riskier for a violation. You are the criminal not me. I do not know anything about select bus service, my metro card transaction proofs that I did not violate any rules of MTA, the conduct of both driver and inspector was inhuman. I even asked the inspector to confirm my statement let me sweep my card here. He said no and told me if anyone ask you for ticket show them this yellow slip. Means driver is not there just to sit down he has other part of the job to communicate with the rider as well. On the other end inspectors are there to issue you ticket so that they can keep there job, and let the management know that they need us because the riders are not paying fares and we are loosing money. I will fight this case to the end. If anyone has any good answer please reply right away, where I have to proof the receipt they have to proof too that the ticket issued was sure a fare evasion. Now I will apply for Appeal. Today I will take that action but if I get your response in time I can learn something from your experience. They owe me a free ride. This is like a civilized mugger is mugging you with $100 ticket. This department should totally be finished by MTA, and the vending machine should be inside so the driver can see every movement of every rider. The ride should be convenience for the rider and not convenience for just writing tickets. They should issue ticket when they can confirm that ticket violation did took place after the reading produced at the stop of metro card where he got you, which gives him the power for sure to issue the ticket it the metro card was paid or not. This department should be closed totally and they can grow there revenue and we can get better service and friendly approach and not hostile approach or disrespect approach from these inspector who have evil mind to just issue ticket to keep there job by hook or crook. Give them a scanning machine and if metro card does not work we will be more than happy to pay $100 fine, not on blind call.
