News Flash!!

The NEW deed shows up on the county recorders website now!!!Whoopa!! I had to print a copy just to look at in all its glory. Now he really can go **** himself!!! I cannot even believe my self restraint, I just want to go and hand it to him. Now I am contemplating as to whether or not to allow him to go through with the eviction so I can have free movers since I don't have to stay here anymore!!! I know when he gets served with the partition he is probably going to have "the big one lizbeth" right then & there. I don't want to be forced to make the decision as to whether or not to dial the phone for the big a**hole. I cannot thank everyone who posted a reply to my OP enough. I wish I could take you all out to dinner & a movie!!!! :D

If it were only possible for you to use a digital video recorder for the chicken dinner; and then again, if it were only possible that it was permitted to be put on the web.

Oh well, maybe some day.

He hasn't a clue yet? Do you have a place to move to? Are you sure it is safe to move out, what might he do to the house if he stays and doesn't want to sell? It might be better if he leaves, remember, you have the evidence to evict him. By he can **** himself did you mean "hang" :confused: :D

He has not a clue!!!! I do not think I can put him out...the QCD went from just his name to his and my name. I really want to start completing some loose end projects around the house, to optimize the selling appeal. I have laminate flooring to put down in the laundry room & a bathroom upstairs I would like to remodel. I have all the supplies for the laundry room and once you get going on the flooring it goes really quick, two days tops. :) The upstairs bath I want to move into the room next to it, so that would be several weeks & we will have to "share" the bath downstairs. I cannot move out, although he thinks he is sitting in the drivers seat so I don't think he would do anything to the house (damage wise). Knowing him he will think he is screwing me by moving himself out & not paying the mtg. fingers X'ed! He will think I am crazy for starting to work on the house again!! My daughter can help, I have taught her how to remodel just about everything! ;)

Officer Stevens called & left a message on my phone for me to call her & "clear up the matter about me driving the car the other day" I haven't driven the car since the "club" incident :confused: I have been down to the station & spoken with two different senior offices about "the car", both said that I cannot have permission one day & then not have permission the next, I carry the insurance & I have the dealership paperwork showing my car was traded in on the car in question for $3000.00. Two different officers came to the house last Saturday & both said they cannot make me give up the keys. The senior officer said he would speak to Officer Stevens on Tues. about the whole harassment thing. He also made copies of everything for a "future civil suite" don't quite know what that means. So I have all my paperwork in hand and am on my way to the station once again. I hate wasting their time.

Well I spoke with Officer Stevens. Turns out she had a cheatin' ex also. She said there are always two sides to every story & she wanted to hear mine. So I explained about the whole car scenario & she made copies of the dealership papers that show my trade in car & the value. She said she will present it to the prosecutor on Tuesday & will then call Gary to let him know that there is nothing they can do to prevent me from driving the vehicle. She was very sympathetic & I asked her not to mention anything concerning the QCD. She said "none of my business".

Very good :D :D :D well looks like you have the right people on your side :D somebody is not going to be a happy camper. Please call the local DV hotline so you can be prepared in case he becomes violent once he realizes his options are gone. Did you ask Ofc Stevens re the hair sample?

I did not bring up the hair sample, like I said I cannot afford to pay for the house on my own, well I could, but just barely :eek: I also do not want to appear to be doing the same thing with the police that he is doing with me. They (police) were not too happy about the extortion/harassment letter I showed them as it is. I do believe that is when the police lost any respect that they might have had for him. BTW, I called the DV Hotline a few weeks ago, they said there is nothing they can help me with until after violence has occured. Go figure!?

Call the DV hotline again, a lot has happened in the mean time and at least they can advise you on how to keep safe, the harassment/extortion letter is a threat already on file with the police. Well since he has alreadfy ruined his credibility with the police depending on what the prosecuter says, you may still want to take action to evict him, since you can afford to live there on your own, beause the stress will get worse once he knows you are on the deed and he can't evict you and has already tried to extort you, he may do something if you leave the house once he figures out all his options are for naught. I suggest giving the police the hair sample like everything else, along with a recent DNA sample (hair brush, razor, toothbrush), tell them you were afraid with all his threats and though at one time he was on drugs, you can give the evidence, they don't need a warrant, it also goes to show his state of mind and intentions in all of this. Let them do with it as the please, then if they remove him, then you are not retailiating. Is his disabled child safe? Does CPS need a call?
He will still owe on his mortgage whether or not he is in the house, however it would still be in your best interest to make sure it get's paid because if they forclose before it is sold you could lose all your investment.

I did mention to the police casually that I found out he was using drugs again, they did not seem too interested. A family member has the hair sample in a safe place. I know he comes from an abusive background, but I have never heard from anyone in the family that Gary has ever committed a violent act, only mental abuse. I am always on the guard, keep doors to our rooms locked, and sleep with a very large mag light flashlight. I will mull this over today and make a decision as to whether or not to go to the police with this info. Officer Stevens is going to call me on Tuesday about the prosecutors reply on the car thing.
