How are people going to cope and protect themselves with the new cash bail law. Won't criminals be having a field day doing dirty things to people?
 


Yeah they do but what rights do we the normal humans have when such a law makes police less to arrest and just ticket the person if they rob you? I'd they kill you how will the law help the police to even arrest someone if you're dead? What will a ticket to the criminal do?

The IL law is not as drastic as you make it. It allows for bail to be set when the suspect is charged with various violent offenses, or where there is convincing evidence the person poses a risk to the community or won't make future court appearances. It's worth remembering that people who are arrested are presumed innocent. Moreover, the U.S. Constitution prohibits "excessive bail". What happens all too often is that persons accused of relatively minor non violent offenses and who are also poor can't meet the bail set and they end up sitting in jail sometimes for many months before their case is resolved one way or another. In short, they get penalized simply for being poor. That is not what bail is supposed to do.

Biden is turning races against each other. You must be out of your mind if you think this law won't be abuse and violence and chaos will happen. Look at the riots of 2020. If you told people in asylums they can be free and they enter the community. Well that is what will happen. Even landlords here worry about their properties. Are you on crack?

No, downtheladder, I am not on crack. I've been a practicing attorney for over 20 years. I have a pretty good sense of what is going on and what the Constitution says. Sadly too many Americans don't actually understand the Constitution, their rights, or a whole lot else about the law.

You say Biden is turning races against each other. Well, Trump was a master at that. Had he been reelected the state of race relations would be even worse.

Nobody is talking about releasing people from "asylums" and the bill to which you refer doesn't say anything about it. Did you actually even read the bill? Or are you just going off what some MAGA pundit said about it?

You are free, of course to oppose the IL bail law and vote out your representatives if any of them voted for it. That's the way the system works, and has worked since 1789. But if you can't stand that others may have different views than your own, then perhaps a democracy is not a system well suited to you.

There remains for everyone pretrial release conditions that must be met. What has been eliminated is only the money necessary for release.

What the elimination of cash bail does is makes the justice system fairer. The new law eliminates the advantage wealthy suspects have always had over the suspects who are impoverished. Wealthy suspects have always been released upon posting bail while those who are poor have had to sit in jail because they can’t afford release.

Homeless people with mental issues. Wait.... didn't that happen a few years ago?
Several years ago in Michigan, the Governor at the time decided it was smart (from a financial standpoint) to close the majority of State-run mental health hospitals, without planning for alternative care or placement of the occupants of these hospitals. The homeless population grew substantially.

It was one of the more boneheaded moves by Michigan government back then.


(By the way, I am chuckling at your slightly-veiled reference. :))
