noise violation in small town. Looking for constitutional rights.

Entertainment An Entertainment permit allows monologues, dialogues, movies, slides, contests, and dancing by employees or performers, and permits certain types of live or electronically reproduced entertainment. This permit is not needed for playing of most types of musical instruments, nor for showing public TV. Available to on-premises licensees, approval of local police and legislative body is required. Licensees may only allow entertainment during legal hours for the sale of alcoholic beverages.

Now on one hand it states a permit is not needed for music, on the other, it also states approval of local legislateve body is required. This alone might give our townn board some control.

Well, that's simply not true. There could be civil remedies available even if there isn't an ordinance or state statute dealing with the noise. Of course that would involve initiating a lawsuit which may not be worth it. I would strongly suggest him meeting and discussing the matter with a local attorney rather than trying to get an answer on this forum.

wow, this is an old thread but I need to post a fiinal follow up here.

At a town meeting some months ago now, I brought along several other town ordinances that specifically limit certain noises. IE. out door speakers! I suggested to them, they could write an ordinance any way they see fit. They had concerns about "noise" ordinances being hard to enforce and I agree with them. BUT they COULD certainly write one that limites any out door amplifiers and that would give them the control over this they dont' have now.
That would not limit the bar from having "entertainment." I don't care if I hear noises coming from a bar. but when my heavy drapes are VISIBLY VIBRATING, that is excessive! Put the sound INSIDE! OR, have a live band but NO SPEAKERS! Either way.

Lots of heads were nodding in that room. The board thanked me for the papers I gave them. And it seems there is another bar in another part of the county doing the same thing and getting the same complaints. This would solve both problems.

It will take them time to get the wording right, they are consulting their lawyer in between other business. BUT I think by next summer there will ba an ordinance.
End of problem!
I want to thank everyone here (and on other boards) who posted HELPFUL advice. As for the "your a two year old" remark, well... You I ignor.

You posted this under the Constitution section of this forum.....yet there is nothing in the constitution about your right to a noise free living enviroment. If you do not believe me read it.

Either you or the bar were there first. If they were there first well then you should have known the liablities of living next to a bar. If you moved in first you should have fought the building of the bar when they tried to move in (and if you did in lost then youur SOL). Either way the bar wins this one.

I have been living here for 13 years. The bar has been here forever and NEVER HAD THIS PROBLEM until this year.
IT WILL STOP!
We are not talking about normal bar noise. We are talking about BLASTED STADIOUM SPEAKERS OURSIDE you can not only hear next door but a MILE AWAY!!!!!!! They shake my walls, vibrate the curain, and when I'm out in my yard you cannot have a normal conversation! THAT IS EXCESSIVE don't you think?

Noooooo, I would move. Not to mention I would never move next to any bar in the first place, whether or not they have had no issues in the past. Its a bar, there are no manners. If you didn't know this as liability when you moved in well, then whose the idiot?

There is the difference. I do not run from problems! Even if I COULD afford to up and move. I like it here. It's not like I just moved in. This is a new thing.

This is a very small quiet town. That bar is small and has been here a long long time without problems. It's the new owners that need to learn how to be good neighbors. There is no reason what so ever they have to all of a sudden produce stadium volumes out of a neighborhood bar.
They obviously don't have the good sense to respect peoples rights, so with an ordinance in place, they will be forced to do the right thing.

Shame it has to be this way but so be it.

As I said before, you have no rights for them to respect. No legal standing, nothing.

I dont run for my problems, I know better than to move next to a bar for a high quality of life.
