Jane you're an idiot. I DON'T WANT TO PROVE SHE IS UNFIT, I KNOW SHE'S NOT. Don't tell me what I can and cannot afford. I am bound by a lease until July and pending a purchase of a home. I may be dependent now considering my logistical circumstances but when the house comes then no.
You are out of line. YOu need to prove that mom should LOSE custody because it is detriminental to the children that she have custody. Then the best interest requirements. I am trying to break down this as simple as I can and I fear that will not be simple enough. CJANE is correct. You are not.

I disagree with the bolded. He is not responsible to supply his ex with a place to live if she doesn't have one. His only responsibility is to the children. If he kicks his ex out of HIS house and she is homeless that is her fault. She should have found a job and made sure she had an income to support her and the children. I don't think any court is going to fault him for her not working. He is not her parent he is the parent of the children. It is totally unreasonable for you to even think that.
Homeless people can/have retain(ed) custody of their children. Seriously. As a GAL i have recommended and the court has granted custody to a homeless parent who was living not in a home/apartment but in temporary housing. Would that happen here? Don't know. But it is definitely possible.

On what grounds? I am far from unfit. I don't drink, smoke, do drugs, beat, abuse, nada, zip, zilch. I haven't even overshot my destination by 150 miles! :)

If a judge decides that then so be it. It will be on the judge's conscience and my ex's to have my kids live that kind of life. It would be out of my hands outside visitation and child support.

Like I said. I am not obligated to provide anything to my ex. I did for years and she failed. My concern is my kids. PERIOD!

Is SHE on the lease? If not, the landlord could come after YOU because she is a squatter under YOUR lease.
Let em keep my deposit!! LOL It would be the best 1000.00 bucks I ever spent.

She will leave. I doubt that will happen. She wont stay in a dark, unfurnished apartment.
