Hello, I live in Houston Tx.. I have a 3year old daughter and I am trying to get her last name changed from her biological father's last name to my last name. See, her biological father does not appear on ANY paperwork at all. He was in jail for most of my pregnancy and was in jail when I gave birth so his name was not written or signed anywhere when she was born. Actually there is still no birth certificate for her because I have not filled in the paperwork and sent it in. Her social does have her biological fathers last name though. He has not been in her life at all and is in jail now. My daughter thinks that she has the same last name as her baby brother and her "daddy" (my sons father) & she is getting really close to going into school and it breaks my heart that she will find out that she doesn't have the last name she thinks she does and will get very very confused. I want to atleast give her my last name because she knows its mommys last name. I want to see what I can do and if I can change her last name with out her biological father's permission or if I would even need his permission seeing as how he doesn't appear on anything and how they're is not even a birth certificate made at all.. Please help :'([/B][/B]

I find it VERY concerning that NO paperwork was filed by the hospital regarding this child. How did you manage this "Mom"?

It seems to me that what you're trying to do is cut the DAD (that's what you call the biological father) out of the child's life entirely and remove any connection that exists between the child and her father. Are you planning on eliminating any mention of her dad to her as she grows older as well?

I believe that the only way to change her name now would involve having a court order it. The court is going to want to know why you want to change her last name. What do you plan to tell them? Do you ever plan on allowing the child to have contact with her FATHER? Will you be asking the court to order the FATHER to pay you child support? What happens when the FATHER decides he wants to be a part of the child's life?

The mother is entitled to name the child Humphrey Winterbottom-Shuttlebum if she wants. Naming the child with Bill Gates' last name doesn't establish that Bill is the child's father...

I agree...but some questions come to mind....

Why did you give the child the father's last name instead of yours to start with?
How did you get a social security number for the child without a birth certificate?
Why haven't you taught the child her correct last name?

I suspect the answers to those questions are:

You thought it was the proper thing to do or didn't understand that the child's last name was your choice.
The child DOES have a birth certificate, you just haven't obtained a certified copy yet.
You goofed.

it is possible to not have a birth certificate. There isn't enough info to determine if there is or isn't though.

Yes, but its not possible to get a social security number without one...or at least not possible to get a social security number based on being born in the US without one...which is the case here.

It's not supposed to happen but I would not say it isn't possible. Our government never ceases to amaze me in one way or another.

I agree that things are not likely to be quite as presented though and it is most likely you are correct.

Well considering this woman is a liar to begin with, why believe anything she says? She is after all lying to her child about her child's name and who daddy is. But whatever. I hate liars. This woman will need to go to probate court, serve the actual father, and see what happens there.

Oh and before anyone says she is not a liar, she admitted to it:

Daughter is only going to be confused because mom has perpetuated the lie for quite a while and didn't tell her daughter the truth. Expect the child to need counseling when she finds out that mommy has lied to her all this time about who her father is.
