What is the name of your state? Live in WA, Court in OR

My childrens father was ordered back in December 2000 to get a psych-eval done as a condition to have contact with our children. Again, in August 2002 he was ordered to get a psych-eval, and to my knowledge he has not attempted to do so.

During all this time, he says he'll do anything to see his children. So why hasn't he got a psych-eval???

What reasons could there possibly be for him seemingly avoiding the court orders which could re-unite him with our children. I don't understand.

Well, the only thing I can think of is that maybe he doesn't have the money to pay for it. Maybe he was financially drained from all the court battles.

Either that or he's worried about what the psych-eval might turn up.

If he's destitute, then whatever county he resides in should be able to put him on a sliding scale. My guess is he either really does not want to see the children or he's afraid of the results of an evaluation. It would help to know why he was twice ordered to submit to an P.E., that itself may be the missing link.

I'm sorry, but don't EVER assume that a father does not want to see his children. I'm siding with the idea that he can't afford it or is worried about the results. If he does not have the money to pay for an eval, does he have medical insurance at all? Most offices accept payments spread out over a period of time. If the eval is ordered and he does not comply, he is also in comtempt right?

I merely asserted 2 options in an 'or' statement. I made no assumptions. If it is financial, then there are many options available for those who are under-insured or living on a low or fixed income. So, the burden of proof seems to rest on what the P.E. would reveal.

Another reason may be that he already got a P.E. and the results were less than favorable.

That court date is getting closer and closer isn't it? Getting a little scared there are ya "butterfree"? Have you told the children he's still alive yet?

now butterfree, this isn't really a legal question but I am going to answer anyway.

In some people's eyes maybe they feel that taking a psych eval. shows that they have something to prove and no one should have to prove they are a fit parent, you should have to prove they are UNFIT!


My question to you is, if this parent didn't do the psych eval. would you allow supervised visitation until it was done?

Well, I just wanted to address that some insurance doesn't cover psych evals at all and others have stipulations so that might not be a possibility.

However, I can say that after paying approx. $1000 a month in child support (I believe attempts to modify downward were not succesful,but I could be wrong).I know some people think, well why not? Well some judges don't care and it's hard as hell to get a downward mod. Also paying thousands of $ in attorney fees to fight for visitation and the allegations made against them I doubt they have the money for it.

So let me ask you something butterfree, I'm just really curious. How come you didn't take the kids to that court ordered supervised visitation recently?

That was a long time ago. Things change. You don't know what his status is now because the two of you don't communicate.

So, is that what took you so long to get back to us? Had to go digging up old posts?

Ahhhh vindictive psycho...uhh I mean butterfree. I was just thinking about you. It's almost Dec 10th. Feeling a little jittery? Have you come up with a good excuse for defying the judge yet? I do believe he's gonna be pissed at you for hiding the children yet again after he ordered you to produce them for supervised visitation with their dad. tsk tsk. Maybe they should request YOU get a psych eval.

On week and counting butterfree! So how about those supervised visitations?
