No, your the idiot. No wait, your clairvoyent. You figured out I'm from Nashville. Wrong again. That makes twice. What a dumbass. Why don't you throw yourself away? Hell, I'll settle for shutting the hell up. You must be a frikkin' yankee. Can't get a real job in law, so you just sit around and take your aggressions out on people that can't reach out and smack the hell out of you.

You consider calling someone a yankee an insult??

You're kidding right? Contraband. Read your state educational code.

Or, would you go to the school and demand your child's confiscated marijuana?
You want to blame someone for costing you the price of a cell phone, don't look at the school. Look at your child who knew the rules and the punishment and thumbs their nose at both.

contraband

--------------------------------------------------------------------------------

I asked a simple question for research purposes. I didn't ask for a smart assed comment from some arrogant *******. Marijuana is illegal; cell phones are not, nor are cell phones banned in this school system. If you don't know the law or a court case relevant, don't give your damn opinion. For your information, Tennessee school law considers beeper/pagers illegal contraband, not cell phones.

I rest my case.

No, you need to keep up. Assuming that anyone has thumbed his/her nose at rules and punishment without knowing anything about the situation is an insult. Suggesting that asking for personal property is the equivalent of demanding confiscated marijuana which is illegal is an insult. Advice should be just that not a personal attack on someone and/or their family. This thread just like most others is just that. You should call the site Jerry Springer forums. The minute someone mentions a problem, you guys call their kids dopers, out-of-control jrs, thugs, and anything else you can think of. It is abundantly obvious that you don't know the law, can't explain what you think you know, and would prefer to degrade people. Furthermore, it's hilarious that you still think it's okay for a school to hold personal property when the state education code doesn't mention it period. Finally, two rulings were shown to me today by a "real attorney" that prove I was right to begin with, and both won settlements in small claims court. Maybe you should consult the Cochran Firm.

Well then, in that case hire one of those 'Attorneys' and sue the school district. After you spend about $5,000 you might be able to get the court to agree that your cell phone should be returned. And the next time your brat takes the cell phone to school in defiance of the School Board policy, you can spend another $5,000 to retrieve it.

As for your idiotic stance on this issue, you seem to be teaching your children just fine. After all, it doesn't matter what the school board says, as long as junior has his "Toy" and no big bully can take them away.

Frikkin hillbilles never learn.

And by the way, for anyone with half a brain (op exempted) here are the school districts (as far as I researched) which ban cell phone use in schools:

Nashville Public Schools
Clarksville Public School District
Oak Ridge School District
Burks School District
Knoxville School District
Brentwood Schools
Franklin School District
(I gave out here)

HOWEVER, none of the listed districts forbid the POSSESSION of cell phones as long as they are NOT used during school hours and ard kept in lockers or backpacks .

Also, The Tennessee Department of Education and The Tennessee legislature allows individual school districts to mandate individual cell phone policy which conforms with state statutes.

In this case, the cell phone is NOT confiscated for being on school grounds. It is confiscated for being USED in violation of the clear PUBLISHED local school board policy.

It is contraband for which the school board and individual schools have legal right to control. Anyone who thinks differently is free to file a federal lawsuit to change the law.

Wrong again. If the policy is changed, a parent wouldn't be denied access again, dummy. Pay attention. I've stated that my issue is only that, and the phone is not being returned to the "brat." Again you show your stupidity by assuming that the phone was taken to school and used. No one has stated that. Only you! Anyone with sense would know to get their facts straight before opening their crap-filled mouth. You guys act as though public schools are perfect in every way and never overstep their bounds. How retarded.
