If she DOES have Herpes, she may sue you for Invasion of Privacy – Publication of Private Facts. She needs the following three elements to present such a claim:
1) communicated facts of a highly personal or intimate nature concerning the plaintiff to a third party;
2) without the plaintiff’s consent; and
3) the plaintiff’s privacy interest in those facts outweighed any legitimate interest that the defendant may have in those facts.

A defamation claim requires only that a FALSEHOOD be communicated to a SINGLE third party.

As you stated earlier, you only gave the information to ONE person, yet somehow the whole office now knows about it. If you lied about her, I hope she does sue you.

I would not talk to her lawyer if he called. You have already established your version of events by the message you left on her machine. You have nothing to gain and a considerable amount to lose, by talking to her lawyer.

Your defense is too lame no matter how many people you tell it to. This comment, “Then I said "good luck, you're the one that has to work with everyone”, pretty much establishes your level of concern for her rights.

You may want to give serious thought to doing the right thing about this situation.

how is it publication if I told a friend of mine because I was seriously concerned. Friends can not talk to one another about events in their lives that may be potentially traumatic? What is this world coming to? I'm sorry, but I think that filing a complaint with the Dept. of Labor is a good idea. I genuinly thought that she had herpes, as a result of her telling me that she did repetidly. The fact that she was my boss, and I dumped her, and the hardships at work as a result, are not an issue to toss aside. I appreciate your input you guys, and thanks.

I'm not going to go over it all again, because you are not getting it or you are playing dumb, it doean't play here and it won't play in court. BTW ir doesn't play with either attorneys or laypersons alike, nor male or female.

When did you get tested for herpes?

Assuming that the evidence of his voice mail message admitting telling his former bosses employees that she had herpes, was already entered into evidence, the next question would be why did he do this?

He will say because he was concerned about his health.

The next quesiton would be, "Did you get a positive test for Herpes before telling this "friend" about his concern?" This is not confidential, since he made his health concern an issue, so he would have had to waive access to his medical records, and we also know, he was advised this would be the case before he filed his eeoc complaint. Since he fails to answer this quesiton here, I would expect he has not been tested at all. This will prove his intent was to slander her reputation because she ended the relationship with him. He left his employment after some time, of his own free will and made no complaint of hostile work environment or sexual harassment, while keeping in continual contact with former co-workers spreading rumors, until after she discovered he was spreading rumors about her, which he would or should have known were not proven and since he didn't get a test had no valid concern.....

If he did have herpes, how would he prove he got it from her? If they both had Herpes, who infected whom?.....

I would also have this article on feral hogs with herpes, ready just in case. :D

I broke up with her while still working with her. She made my life hell the duration of the time that I was there. I then quit. I have not been tested, since there has been no evidence of the STD for me. She told me she got the STD from her X. She cried about it. I am not in the wrong here.

That's not the point.
If you had no signs of herpes, then you had no health concern's, thus no reason to tell her employees.
You were not concerned enough to get tested. Therefore your acts were intentional to harm her.
You were not complaining about sexual harassment and/or hostile work environment and filed no complaint until after she discovered you had been telling her employees that she had herpes, when you had nothing to support that accusation.
